Drudge Retort: The Other Side of the News
Tuesday, October 08, 2019

Committee on Foreign Affairs: "The House of Representatives is engaged in an impeachment inquiry to determine whether the President violated his oath of office and endangered our national security by pressing Ukraine to launch sham investigations to assist his personal and political interests rather than the interests of the American people. Today, the White House has once again attempted to impede and obstruct the impeachment inquiry. "This morning, we learned from Ambassador Sondland's personal attorneys that the State Department left a voicemail last night at 12:30 a.m. informing them that the Trump Administration would not allow the Ambassador to appear today as part of the House's impeachment inquiry. In addition, Ambassador Sondland's attorneys have informed us that the Ambassador has recovered communications from his personal devices that the Committees requested prior to his interview today. He has turned them over to the State Department, however, and the State Department is withholding them from the Committees, in defiance of our subpoena to Secretary Pompeo. These actions appear to be part of the White House's effort to obstruct the impeachment inquiry and to cover up President Trump's misconduct from Congress and the American people. Ambassador Sondland's testimony and documents are vital, and that is precisely why the Administration is now blocking his testimony and withholding his documents. We consider this interference to be obstruction of the impeachment inquiry. "

The letter came hours after the White House blocked the interview of a key witness, Gordon D. Sondland, the United States ambassador to the European Union, just hours before he was to appear on Capitol Hill.

The strategy, if it holds, carries substantial risk to the White House. Privately, some Republicans had urged the White House to allow witnesses like Mr. Sondland to appear, in order to deflate Democratic accusations of a cover-up and offer a public rationale for the president's actions toward Ukraine. Now, some Republicans worry, Democrats have more fodder to argue publicly that Mr. Trump has something to hide.

...

Speaker Nancy Pelosi said it was too early to know whether Democrats might draft an article of impeachment based on the obstruction issue, akin to one adopted by the House Judiciary Committee in the 1970s impeachment proceedings against Richard M. Nixon.

If Donald's latest gambit doesn't do the trick for him what do you think he'll do next? Resign? Try to arrest a few members of Congress? the second option is much, much more likely.

Let's hear it repubs - does congress have oversight over the executive branch or not?

This is history. If you say the president unable to be indicted, AND doesn't have to answer to congress, then congrats, what we have now is a king, a ruler who is literally above the law and all accountability. Is that the belief you want to sign your name underneath in the history books?

Turnabout is fair play. If you're going to say trump doesn't have to cooperate, then you're saying NO PRESIDENT will EVER have to cooperate, and the system of checks and balances is dead.

You are both rationalizing and are displaying ignorance of both history and civics.

Removal is a tall hurdle by design. 2/3 of the Senate is needed.

The House needs to convince the Senate, but more importantly it needs to convince the public. When one party tries to thread the needle and completely shut out the other House members it's a clear signal that a case hasn't been sufficiently built.

Do it the right way or just stop.

It will be exactly how it needs to be. It will be a constitutional event. These are rare and will be full of lessons. Sit back. Fire up the popcorn and enjoy the show. It's what you wanted. Now try to learn something. I am actually very excited that we might actually doing this. I realize it may take time and will probably not remove him from office. But it is necessary now. And it will change things. We cannot continue like this forever. And our elections are not free for all's with no rules. Rules to reflect our American ( not Russian) constitutional values and for how we want America to be a more perfect union. We have rules and the President is not above them.

Privately, some Republicans had urged the White House to allow witnesses like Mr. Sondland to appear, in order to deflate Democratic accusations of a cover-up and offer a public rationale for the president's actions toward Ukraine.

#2 | Posted by BruceBanner

Of course, this approach will only pay off for Trump, and the Republicans, IF and ONLY IF Ambassador Sondland's testimony is BOTH accurate (i.e. truthful) AND it supports Trump's claims. If Sondland is NOT is a position to do BOTH of these at the same time, then indeed, it would be best for Trump if the Ambassador catches the next plane back to Brussels.

No, what I said was what the Democrats are currently describing as an 'impeachment inquiry' is a sham as it pertains to being a meaningful impeachment inquiry.

Mueller laid out obstruction. For some reason Dems aren't satisfied with that and are seeking more. Fine. The problem is they (and their allies) have gotten WAY ahead of themselves.

The legislative branch is COMPLICIT. Not obsolete.

Give me a break dude. They're obsolete. They serve no purpose. The house isn't doing anything and the senate is the executive branch's lap dog.

The legislative branch is supposed to be a separate and equal branch of the federal government.

Currently it's weak. It's pretty much how the senate failed in Rome.

As Lee said above, "This'll be the most consequential battle for the future of America on our soil since Yorktown.

#36 | POSTED BY LEE_THE_AGENT"

If the legislative branch can't step up to the executive branch. Right now. Then we are living in a dictatorship.

If Trump wins 2020. He will change how our government, and America works.

Then push the process. This isn't rocket-science. It's Civics101.

The process is escalating impeachment in the House. Problem is, doing so enables Republican House members to participate and it involves the Executive to defend itself. But it also gives the House legit subpoena powers.

QFT

The Institutional Framework of Congressional Oversight: Purposes, Powers, Limitations and Practicalities

3. The Powers and Tools Available to Congress for Conducting Investigative Oversight
B. Congress's Ability to Obtain Documents and Witness Testimony

Rules of standing committees: The rules or practices of standing committees may restrict the issuance of subpoenas only to full committees or in certain instances allow issuance by a committee chairman alone, with or without the concurrence of the ranking minority member. During the 114th Congress fourteen standing House committees empowered their chairpersons to unilaterally issue subpoenas, double the number so authorized in the 113th Congress.(18*) The ranking minority member of these committees cannot block the subpoena but usually must either be consulted or given notice prior to the issuance of the subpoena. Subcommittee on Investigations permits the chairperson to issue a subpoena without the consent of the ranking minority member.

18* They are the House Committees on Agriculture, Education and the Workforce, Energy and Commerce, Financial Services, Foreign Affairs, Homeland Security, Judiciary, Natural Resources, Oversight and Government Reform, Rules, Science, Space and Technology, Select Intelligence, Transportation and Infrastructure, and Ways and Means.

Challenges: A witness seeking to challenge the legal sufficiency of a subpoena has only limited remedies to raise objections. The Supreme Court has ruled that courts may not block a congressional subpoena, holding that the Speech or Debate Clause of the Constitution 22 provides "an absolute bar to judicial interference" with such compulsory process. 23 As a consequence, a witness's sole remedy generally is to refuse to comply, risk being cited for contempt, and then raise the objections as a defense in a contempt prosecution. Challenges to the legal sufficiency of subpoenas must overcome formidable judicial obstacles. The standard for whether the congressional investigating power has been properly asserted was articulated in Wilkinson v. United States: 24 (1) the committee's investigation of the broad subject matter area must be authorized by Congress; (2) the investigation must be pursuant to "a valid legislative purpose;" and (3) the specific inquiries must be pertinent to the broad subject matter areas
which have been authorized by Congress.

The House Rules in both 1974 and 1998 were different and the committees had to procure overriding subpoena power through a formal House vote on impeachment inquiries.

Since the 114th Congress, the House rules were changed to grant this power inherently to the above select committees (18*) where no other vote needs to occur in order for the subpoena power of a formal impeachment inquiry to be wielded by their chairmen. Nancy Pelosi has decried that a formal impeachment inquiry is underway and that is the only regulatory requirement necessary to compel the Executive Branch to cooperate with subpoenas and provide witnesses for testimony.

Repubicans getting their panties in a twist over how the Democrats are going about the impeachment process is amusing. The playbook being used is the same one that was used on Nixon and Clinton.

This wannabe dictator is unpresidented, though. In the past, we did not have a sycophantic Senate and State-run media to cause the frothy conserva-rage over traditional processes. Nixon was crooked, but not anywhere near as crooked as the traitor occupying the White House today. The desperation is palatable. I'm with moder8 on watching DJT imploding in real time...up to the point I have to remind myself that he has the nuclear codes.

The Orange Menace was creepy, weird and unhinged before he became president*...for some reason, not-liberals thought he was cool. Just look at the guy: fat, dresses like he shops at Men's Wearhouse and never learned how to properly wear a tie, spray-tan orange with tanning bed raccoon eyes, has a visor combover on his scalp, eats garbage food, ruins steak, can't string together coherent sentences, is clearly high af most of the time with his dilated pupils, sniffing and word-slurring, hangs out with pedophiles and dotes over love letters from tin pot dictators. And that's just the good things about him. All you people who defend the dude are going all-in trying to convince anyone who will listen that he is the coolest cat in the country. I'd be embarrassed for you, but I don't have the energy for that kind of effort, LOL.

We American patriots need to stick together...the entire Repubican Party has abandoned America and the Constitution.

Pathetic.

At the end of the day, this is the electoral college's fault. Not because trump lost the popular vote, but because it was supposed to be their job to ignore the will of the voters if the voters elected an unstable sociopath. It was obvious to anyone with a brain that trump's presidency would be like this. They failed to do their duty and they should cease to exist.

Is this right?
If the House Dems issue a subpoena, it must be honored.
If the House Reps want to issue a subpoena, the majority can stop that subpoena.

Imagine who the Repubs will subpoena in the House inquiry?

If the Dems deny those subpoenas, are they obstructing?

If Trump is impeached and this moves to the Senate, who has majority subpoena power?

If those House Repub subpoenas are stopped by the Dem majority, the Senate Repubs may push those subpoenas through.

Biden and son and many others will testify, if not in the House, the Senate will.

I find it highly amusing that a person who doesn't understand the process is calling someone else a dum dum. I wonder why that is? Actually, I don't wonder. I know:

The study of psychology teaches us that when someone resorts to name calling, it usually speaks to feelings of inferiority and a feeling of inadequacy of the person doing the name calling. People stoop to the process of name calling when they feel lesser and need to make themselves feel more powerful.

Executive and legislative branches are co-equal. The president has all the power over the executive. The legislative branch (in this case the House) needs to act in concert to get things done and not on the say so of one person. This should be especially so on something as serious as impeachment. Vote so that at least we get a nod to due process and that the majority of the House wants to go forward on the record.

This article does not necessarily support my world view, but does lay out the arguments about a vote to make the inquiry formal:

If you REALLY want intellectual discourse from me on trans issues. Don't post from garbage pie websites. Also it would help if you weren't so transphobic and bigoted. You can't get through to those people.

You're not capable of intellectual discourse on trans issues.

You just label anything you disagree with as transphobic. Exhibit A: Trans women competing in women's sports.

So funny watching Republicans piss themselves about rules and procedure, when they are the ones who, as Tony highlighted, changed the rules.h

Yeah. The same party who just decided that presidents can now only appoint supreme court justices if their party controls the senate.

Rules mean everything when it helps them, and nothing when it stands in their way.

"You should have "predator" tattooed to your chest so that when you try to barge into a women's locker room they know what they are dealing with."

What a totally disgusting post Jeff. You should be ashamed of yourself.

You've become a complete WOB. You should have "predator" tattooed to your chest so that when you try to barge into a women's locker room they know what they are dealing with.

No. Dems have full subpoena power WITHOUT a house vote. So...yeah. Go ---- yourself. We don't take orders from traitors.
