Drudge Retort: The Other Side of the News

HARTFORD, Conn. (AP) -- The families of three female high school runners filed a federal lawsuit Wednesday seeking to block transgender athletes in Connecticut from participating in girls sports.

Selina Soule, a senior at Glastonbury High School, Chelsea Mitchell, a senior at Canton High School and Alanna Smith, a sophomore at Danbury High School are represented by the conservative nonprofit organization Alliance Defending Freedom. They argue that allowing athletes with male anatomy to compete has deprived them of track titles and scholarship opportunities.

"Mentally and physically, we know the outcome before the race even starts," said Smith, who is the daughter of former Major League pitcher Lee Smith. "That biological unfairness doesn't go away because of what someone believes about gender identity. All girls deserve the chance to compete on a level playing field."

It doesn't matter what gender these people think they are. Their genes and hormones say they're men. They shouldn't be allowed to compete in women's events. If they want to dress like women that's just fine. Their choice. But they shouldn't be allowed to deprive women of scholarships that are supposed to go to women.

It's a clear Title IX violation.

Think about it this way - have Connor McGregor take testosterone suppressors for a full year. There is not a woman in his MMA weight class who would even consider stepping into the ring with him even with lowered testosterone levels.

"It's a clear Title IX violation."

JeffJ, serious question:
Why are you incapable of viewing justice as a balancing act of competing interests?

I understand it. Currently a fair category for men transitioning to women doesn't exist. Testosterone blockers put them at a biological disadvantage on the men's side but on the women's side they still have inherent and unfair physical advantages.

#10 | Posted by JeffJ at 2020-02-13 02:15 PM | Reply

Since you say you understand it, tell us what the competing interests are.

Thanks.

#11 | Posted by snoofy at 2020-02-13 02:23 PM | Reply

I should have been more clear. You mentioned a Title IX violation; what is the other interest(s) at stake here?

#12 | Posted by snoofy at 2020-02-13 02:25 PM | Reply

#11 I thought I did.

Transitioning transwomen don't currently have a category where they can fairly compete in their chosen sports.

So, they can try and compete in men's sports where the drugs they are taking put them at an unfair disadvantage or they can try and compete in women's sports where they have an unfair biological advantage even with testosterone blockers.

The competing interests are transwomen, who don't have a category where they can fairly compete and ciswomen who can't fairly compete with transwomen, even with the use of testosterone blockers.

#13 | Posted by JeffJ at 2020-02-13 02:29 PM | Reply

That's good but it's not Title IX.
Title IX doesn't care about transgender.
It only cares about men and women.
You seem to be advocating a separate but equal new gender for trans.

#14 | Posted by snoofy at 2020-02-13 02:33 PM | Reply

The arguments you're making about transgender athletes having an advantage really no different than arguments about athletes on steroids having an advantage which is particularly apropos since sex hormones are steroids.

Yes. Which is why this is going to court. Title IX focused on biological sex, not the new malleable term of "gender".

Allowing transwomen to compete in women's sports is a clear violation of Title IX.

The only way it can lawfully happen is for a new law to be passed updating Title IX. Of course, judicial activism could accomplish it, but I think an appeal would likely be successful.

No, they actually are different. There's a difference between biology - which we can't control - and voluntarily taking PED's or anti-PED's. Men have immutable inherent physical advantages over women, even with testosterone blockers. Full stop.

#17 | Posted by JeffJ at 2020-02-13 02:39 PM | Reply

Okay, but sex is legally malleable, so that won't work.

Hey man, I've got to step away for a bit. We got some snow today and while it's not much if I don't shovel it the snow will turn to ice tonight as we are going to approach zero degrees Fahrenheit.

"Full stop."

Not full stop, since it's a two-way street.

Women have all kinds of physiological advantages over men, they just aren't highlighted in sporting events; not surprising, as sports are traditionally created and competed by men.

Not as well as women at producing breast milk, or multitasking*, or living longer.
Or in these sports-related attributes either, one of which ironically includes "balancing.":

Just have another category "Other".
Men, Women, Other. Seems fair. Just compete against your category.

High School Runner Not Feeling Great About Her Chances Against The Girl With The Beard

HARTFORD, CT--Local high school track runner Vanessa Vogel was excited for her track meet this past weekend, having trained many months for her shot at a record and possibly a college scholarship.

But when Vogel lined up and saw a brave runner with a beard from a nearby high school, she started to doubt her ability to compete.

"You know, I have a bad feeling about this," she muttered as she lined up for the 800-meter dash. "I'm just not sure I can take this girl."

Sure enough, she was blown out despite setting her personal best.

"I just don't know if that was entirely fair," she commented afterward. "I'm all for equality and stuff, but I dunno -- the beard might have given her an advantage."

Vogel has been suspended pending an investigation into her bigotry.

Separate but equal has already been tried in the courts - time to end segregated athletics and award positions based on merit only - not gender identity. Women - you made this, now reap the rewards.

PORTLAND, Ore. - The Ninth Circuit Court of Appeals today issued an opinion affirming the district court's dismissal of a lawsuit that sought to challenge policies that protect the legal rights of transgender students in public schools in Dallas, Ore. The Court found that Dallas High School's practice of allowing a transgender boy to use the boys' restrooms and locker rooms does not violate the rights of cisgender students or parents.

The ACLU, ACLU of Oregon, and Lane Powell represented Basic Rights Oregon as an intervenor in the case to defend the Dallas School District's practice of permitting a transgender boy to use the same restrooms and locker rooms as other boys.

Get used to losing on this issue Jeff.
