Former Obama administration national security adviser Susan Rice has called for the Trump administration to release transcripts of phone calls between Michael Flynn, her successor under President Trump, and then-Russian Ambassador to the U.S. Sergey Kislyak.

"In the interest of transparency, Ambassador Rice again calls upon the Director of National Intelligence to release the unredacted transcripts of all Kislyak-Flynn calls," spokeswoman Erin Pelton said in a statement on behalf of Rice. "The American people deserve the full transcripts so they can judge for themselves Michael Flynn's conduct."
Trump's misuse of the new DNI has been using selective leaks trying to rewrite the history of why Flynn ended up in trouble in the first place. Since the information is still classified, none of the Obama officials are free to discuss the actual content of Flynn's conversations and why they rang alarm bells during the waning days of Obama's tenure as President.

If the appellate judges have access to these phone transcripts I think they will view Flynn's plea and admissions in a completely different light than that of someone claiming to be innocent because the FBI didn't have a material reason to ask him questions about these phone calls.

I think Judge Sullivan received clearance to either listen to the calls or read the transcripts which moved him to say Flynn's behavior amounted almost to treason. This is not going to end well for Trump, Barr, Shea, or Flynn unless the President can shut this down with a pardon before the judges dive into the actual details underlying Flynn's sworn pleas of guilty.

In this now declassified email that Susan Rice sent herself, we see that President Obama refused to request law enforcement investigations of Team Trump's known Russia ties and insisted that any actions be "by the book." Apparently, "Obamagate" means doing the right thing.

Of course today's Republican Party - controlled by Donald Trump's sociopathy - would try to imply that President Obama's express request that something be done "by the book" is itself a scandal on par with Watergate (smh).

I hope Sullivan sends that piece of crap to prison. I know Donald Trump can pardon him but he would still have to live with the stigma of being treasonous and Trump would have to live with the stigma of pardoning such a piece of crap. It sort of makes Trump, himself, look treasonous which is actually what I believe to be true.

If Trump pardons Flynn, I believe Flynn would be unable to claim 5th Amendment protection should he be called to testify before Congress.

I believe this would open him up to potential criminal contempt consequences for refusing to testify and potential perjury charges should he testify falsely.

If I am not understanding correctly, and I may be, I'm sure one of our Retort lawyers will correct me.

Absolutely correct. Since Flynn would already be pardoned, he no longer would have a need for 5th Amendment protections for those offenses. This exception is likely the reason Trump hasn't pardoned Manafort or Stone either. Once pardoned they have to divulge what they know if asked by a recognized legal authority.

OWS and Tony, thanks for those thoughts, it hadn't occurred to me how a pardon might expose Trump, very interesting. This is almost an HBO series with all the twists and turns.

Why not release the transcripts? If there was no crime, there is nothing to hide. If Flynn is such a great guy, he will be pleased to see his discussions with the Russians brought into full light. On the other hand, if Mikey was practicing foreign policy without license, making promises which undercut the current administration's policies and making plans for future agreements, that might be considered, oh, treason...

I've always wanted to see what a "perfect phone call" was like.
