Drudge Retort: The Other Side of the News

President Donald Trump signed an executive order on Thursday aimed at making it easier for people to sue Twitter and other social media platforms for what Trump and his allies have denounced as unconstitutional political censorship. But any future First Amendment lawsuits that Trump has in mind will run into a problem that his order doesn't appear to address: a US Supreme Court decision written by a justice he appointed, Brett Kavanaugh.

Just this week, the US Court of Appeals for the DC Circuit cited that Kavanaugh opinion when a three-judge panel rejected a First Amendment claim against Twitter, Facebook, Google, and Apple brought by conservative activists, including far-right media personality Laura Loomer, who argued they'd been deplatformed and censored in violation of the First Amendment.

And earlier this year, the 9th Circuit relied on the same Kavanaugh opinion to reject an appeal from Prager University, a nonprofit that produces videos about conservative issues, which had sued YouTube for restricting access to some of its videos.

"Social media platforms are not the government, they are not public fora, trying to superimpose that kind of framework on this makes no sense, and the courts have uniformly held that," First Amendment lawyer Bob Corn-Revere told BuzzFeed News. Someone must have told him that this was not going to fly, and if they did, it just proves that this was nothing more than another 'shiny object' tossed out there to distract the media from his handling of the pandemic. Of course, he's probably kicking himself right about now since he wasted a perfectly good 'shiny object' as the media is now totally caught-up in covering the riots in Minneapolis/St. Paul.

Fat Nixon only did this to portray himself as a victim. It's what he does best....play the victim.

He blatantly lies on twitter, gets fact checked and he starts whining and playing the victim card.

What a snowflake.

The problem is the media, being silent for four years while he is compulsively lying and giving him a platform enabled him.

Now his favorite outlet to push his pathological lies standing up to him in the very smallest possible way and he freaks out like the snowflake that he is.

He let two months pass before lifting a finger to do anything to stop the coronavirus while it began running rampant in the US.

Twitter fact checks him and boom 48 hours he signs the "Trump is Butthurt" executive order.

Can we stop pretending Kavanaugh won't do an about-face if it means upholding something Trump did? The Court's Republican operatives don't give a ---- about precedent even when it's their own.

Lawyers can always find a way to say "this is different."

The Order was a mistake. In signing the Order, many nutso Conservatives feel relieved like they won.

Voters who think they've won are less likely to go to the voting booth.

If he was smart, he would have just complained about how the Right is SO persecuted to get people angry and get them to vote.

If one of these cases gets to SCOTUS, be prepared for a serious case of whiplash as Judge Keg immediatly reverses his opinion to side with the Resident.

This was always just a Trump hissy fit all along. A baby having a temper tantrum. And it will be treated by the Courts as such.
