It's hard for Americans to imagine that a president who lost a bid for re-election would refuse to leave office. But in recent weeks some analysts have done more than imagine it: they've begun to explore what can be done if Donald Trump does just that.

Why are some people so bent out of shape over what would happen if Trump lost the election? While yes he could cause (even more) chaos, on Jan 20, 2021, "HIS TERM EXPIRES". Note the emphasis on "HIS TERM EXPIRES". A new president doesn't have to be sworn in for Trump's term to expire!

If for some reason, Biden can't be sworn, the position of president becomes vacant. The constitution makes provisions for succession in the event of such a vacancy i.e. the VP (Pence would take over). However, since Pence's term also expires on Jan 20, 2021, the next person in line, the Speaker of the House would automatically assume the job.

A new congress gets sworn in early in January 2021 and if dems maintain control of the HOR, you can bet that a new speaker will be sworn in prior to Jan 20, 2021. If that new speaker is Pelosi, does anyone think that she would hesitate calling on federal law enforcement to evict Trump's fat ass of out the WH? She has already stated that she wants to see the POS in prison. If Trump tried to stay in the WH after his term automatically expires or called on his supporters to revolt, such an act of defiance would be considered treasonous and would incur serious consequences for him and his supporters.

If Trump loses, rest assured that he will vacate the WH; by choice or by force. Either way, he's gone.

But it's hard to put that genie back in the bottle without significant events to do so. They're not going to quietly slink away after an electoral defeat.

In fact, I've even predicted that if Trump loses this year we'll have four good years left of our country's existence.

Because they'll lick their wounds and twist themselves up even further into their victim complex with Trump's ouster being the ultimate offense against their beliefs. The next person they elect is going to be scary.

I am much more concerned about Trump fearing he will lose the election so he weaponizes the intelligence services and FBI to illegitimately investigate his political rivals. It would be unimaginatively corrupt for him to say...wiretap his opponents campaign or pay a foreign intelligence service to write up a completely false dossier but then order his intelligence services to treat it is true meanwhile leaking all of the details to the press. If he wanted to be truly devious, he could also use corrupt US and foreign intelligence services to try to entrap low level staffers and lie to FISA courts to get additional surveillance capabilities. However, if he we truly evil, he could then use all the known false information to disrupt 3/4 of the next president's term by falsely accusing them of being a Russian agent. Hell, he could even force them to hold impeachment hearings during the crucial early days of a viral pandemic.

No. No party/person could possibly be that corrupt unless their intent was to destroy America.

Actually, I think it was Dick Cheney who had to be threatened with trespassing to get him moved out of the VP office. It took even longer to get him to move out of the VP mansion.

Cheney was one pissed-off dude. Remember when he arrived at Obama's inauguration in a wheelchair so he didn't stand up for the applause. (He claimed he had a back injury from lifting packing boxes. Yeah, sure ~ LOL).

POINT IS there's no provision in the Constitution that allows for an "extension" or a "hold over" of a president's term of office regardless of pending lawsuits, etc. Trump can throw himself on the floor and hold his breath until he turns blue. It doesn't matter. If he's not reelected, it's over at noon on January 20. And so is all of his authority.

The Constitution has a number of different remedies to preserve the continuity of the government if, for some reason, Biden cannot be sworn in, including but not limited to a congressional appointment of a pro tem eventually if necessary.

It's common courtesy for a former president to attend the swearing in ceremony of his successor with smiles and glad-handing.

Since Trump has never shown one iota of "common courtesy", I can't imagine him even being in D.C. at the time. He's not the type to surrender gracefully with such dignity and aplomb.

My prediction is he'll remain at Mar-a-Logo, on the phone screaming obscenities at his attornies or anybody else who will still take his call.

You might want to keep in mind that Air Force One, if in mid-flight, changes it's call letters at 12:01 on January 20th.

If Trump opts to remain at Mar-a-Lago beyond that date and time, it's no longer at the disposal of a "former" president. It will have to return to Washington D.C. empty.

Preet Bhrarra. Schiff needs to stay as chair in the House and work that end of the needed investigations.

Unless there is something in his background that I'm not aware of, Preet would be the perfect choice to lead the DOJ back to its historical role of providing fair justice, impartiality, and independence from the White House.

Needed investigations? We let Dubya off the hook so he could go paint pictures in Dallas. It's a tradition. We don't prosecute former Presidents. Trump knows this and needs to know we will continue that tradition otherwise the change of power will become far less traditional and much more difficult.

If trump loses, on jan 21, 2021, trump is no longer the president. Swearing in, the whitehouse, are nothing but technicalities. Biden can be sworn in at McDonalds. He can run the country from Camp David until trump leaves. The whitehouse is just a house where the president lives. The operational part of the house can be moved to the alternate locations--we do have several alternate operational locations for the POTUS. We can just let trump stay there and pay rent until he leaves.

Almost ALL of his supporters inside the beltway know that not vacating office in the face of an election defeat, in the Electoral College and certified by the legislature, would open each to charges of conspiracy to overthrow the US Government. People get shot in public, in front of a firing square, for such actions.

The peaceful transfer of power is one of the greatest things about America. If Trump wants it the other way, that can be arranged. The US Military is no friend of this president, and will uphold its collective oath to the Constitution. Only Melania could be spared (well, maybe Barron, too. Maybe)...

Trump will be cowering at Mar-a-Lago. Pence will be on a plane enroute to Indiana. Melania doesn't give a damn and poor Barron is a juvenile still tied to his mother's apron strings.

Anybody else who refuses to vacate the White House on demand will be charged with Trespassing by order of the Capitol Police. (Not the military) much like what happened when Dick Cheney refused to relinquish his VP office to Joe Biden.

Nothing would please me (and the media) more than to see Trump boarded up and barricaded inside the Oval Office screaming obscenities at the Capitol Police.

In which case, it won't be the military. It will be a couple big burley guys in white coats from Walter Reed Hospital carrying a strait jacket.

Trump hasn't gotten around to re-writing the Constitution yet. He was saving that for his second term.

Until then:

Trump's term in office EXPIRES at noon, January 20th. No matter what. There is no provision in the Constitution for an "extension" or a "holdover."

The Constitution does provide for a congressional appointment of a "pro tem" if it becomes necessary.

Trump can litigate all he wants. He can scream, holler and throw F-bombs at the system. He can throw himself on the floor and hold his breath until he turns blue if he wants to. It doesn't change anything. Unless he is re-elected he has no authority after noon, January 20, 2021.

The House and the Senate is another story. A Trump tantrum like you describe would likely make Nancy Pelosi the President of the United States for a while. (Trump's worst nightmare, LOL)

The Constitution clearly states when Trump's Presidency is over. He can kick and scream, refuse to leave the White House just as Mary Todd Lincoln did but the new President will be take the oath of office even if it has to be done at a different location and will then be President and there is nothing Donald Trump can do about it. After a short time Trump would be forcibly removed from the White House and his embarrassment will be recorded in every history book forever.
