President Donald Trump explicitly floated delaying November's presidential election on Thursday, lending extraordinary voice to persistent concerns that he would seek to circumvent voting in a contest in which he currently trails his opponent by double digits.

While states have the authority to delay their primary elections, only Congress can change the date for the general election for president, because the Constitution gives Congress the authority to set the general election date.

Since 1845, Congress has required the appointment of presidential electors (now by election in every state) to take place on the Tuesday after the first Monday in November, which this year is November 3.

There are "conservative" posters active right now on the DR that claimed Obama was going to do just this. Even though he never mentioned or tweeted anything remotely similar
They were so adamant and smugly sure, like always, even though the president doesn't have the authority

Nancy Pelosi when she takes office as President on Jan. 20, 2021 as per the Constitution. Trump's term is up at noon of that day, election or no election and she would then inherit the Presidency because Mike Pence's term also expires at the same time. Then she could have him arrested if he gives her any crap.

Okay. Now consider states with divided government and bad faith Republican legislatures, like Wisconsin, Michigan and North Carolina. If Trump really wants to delay the election or sow discord with respect to the results, you need to anticipate unprecedented levels of obstruction, litigation and other ------ up unimaginable things happening in those states.

For example, let's say the results in Wisconsin on 11/3 show Trump with a narrow lead but 1,000,000 absentee ballots left to count due to Covid which will take weeks to accomplish. I don't think for one second that the scumsucking Republican Wisconsin legislature won't send results showing Trump as the winner to Congress, even if it is not their prerogative to do so, and file suit to stop the counting which will end up in (you guessed it) a 5-4 Republican SC, or worse the state's own 4-3 Republican SC. The backdrop for the weeks it takes for that to be resolved will be Trump screaming 24 hours a day and using every federal asset at his disposal (including DHS, the DOJ and the military) to get his way.

Politics are different today. I read your posts and really feel like you are living in a different era. If an election takes place on 11/3 there will not be results that day due to the number of people voting by mail due to Covid, and the deck is stacked against Dems to fairly and competently handle what comes next.

I realize i just went on a tangent unrelated to delaying the election, but the same principles apply. There are swing states with powerful Republicans who will do everything they can (and even things they can't) to help Trump. I am confident when i say America is about to witness the most contested, ------ up and possibly violent election of the modern era.

That's irrelevant. The law covering the succession of the presidency says that when the President and Vice-President is not able to serve, it falls to the Speaker of the House, NOT to an elected member of the House. While it would seem that the Speaker of the House would automatically have to be an elected member of the House, that's not how it works. The Speaker of the House can be anyone that the House elects to that position, whether they were a member or not.

The rules are the rules, you play by them and if you lose, you accept it. The fact that Democrats are incapable of doing this is all the more reason why Republicans have a responsibility to stand up for the constitutional democratic system, or nobody will.

The election won't be delayed; Trump has no legal power to do this, and House Democrats have no reason to accommodate him by changing the law. Even Trump is likely aware of this. Begging for something he has no power to do and no leverage to demand just makes him look weak. It is also a glaring statement of no-confidence in his own ability to compete in the election.

It is time to search the U.S. Code for any emergency powers act that would allow him to override Congress. There may be one because the right wing was terrified that Obama would declare an emergency and take everyone's guns and put them in FEMA camps.

Any such law should be repealed immediately. If the GOP will not go along with repeal we know what is coming next.
