When Supreme Court Justice Antonin Scalia died in February 2016, Senate Republicans came out of the gate insisting that his seat not be filled due to the presidential election about nine months away.

Poor Obama has had such a problem with "legacy" ever since his was Donald Trump.

#2 Trump is not Obama's legacy. He's the legacy of millions of racist half-witted American voters; the flaming bag of dog ---- Vladimir Putin left on America's porch.

Should a Scotus Confirmation occur before the election, consideration must be given to packing the Court if we are able to elect a Dem majority in House, Senate and win the Presidency.

13 SCOTUS Justices should be the new Court make-up.

Of course Obama should be one if the appointments.

And Michelle. And Andrew Cuomo and Jon Stewart.

Rs think this is a completely different situation from 2016. That was a black D President. Now it's a white R. To Rs that's all the difference in the world.

You're Trump's legacy.

Sad!

Obama's legacy looks ever the more saintly in comparison to Trump.

EXACTLY! In fact, I would go so far as to say even a confirmation is made AFTER after the election and Biden wins, packing the court should occur.

Biden has already stated that he wouldn't consider packing the court which brings me back to the problem with Biden: he is to wedded to the idea of the senate being an august, honorable institution; the most deliberative body in the world. I am afraid that he won't take the steps necessary to recognize just how far the senate has moved away from what he thought it was. He, in effect, wants to make the senate great again (MSGA).

Biden is going to tick off a lot of his supporters but (hopefully) they will hold their noses and vote against Trump.

"That's their job. There's NOTHING in the Constitution that says the President stops being president in his last year." -Ruth Bader Ginsburg, on the Senate's obligation to assess Merrick Garland's qualifications.

Re: #10

That ship sailed, the precedent has been set. Ridiculous to suggest that a new justice should be rammed down our throats with less than two months before an election, with a special case traitor currently as President.

Compared with Trumpy's legacy of killing nearly a half a million Americans with his hateful ignorance and criminal negligence?

I don't see the problem with Obama's legacy. Obama was a good President and Obama is still a good man. He did not kill hundreds of thousands of Americans with his criminal negligence.

I cringe to think what Trumpy's retirement years will be like. I hope he Enjoys spending all his time and money in the courts. I will enjoy watching him fall off of his wall.

Brace yourself. It's happening.

Then all the nuts saying they're going to riot on twitter, if they do it, Trump wins the election pretty easily.

Yeah. I don't think so.

Like Trumpy likes to say.

We'll see.

Law and order is overrated. The Nazis had great law and order. Street crime was almost non existent in the USSR. I doubt the people in those countries want to go back. I'm sure some do,but we have authoritarians everywhere.

Trump is goin' down and I'm lov'in it.

More than half of the country now realizes how unfit Trump is for office, how much of a mobster conman he's always been. He may still steal an election, but it won't be fair and square. And regardless, whether Trump or Biden wins, it's not going to be pretty. The Boogaloos will continue their ----, cops will continue brutalizing in the name of "protecting and serving", other brownshirts will be out, AntiFa will be there to meet them. There will be protests and counterprotests, murders and coverups by complicit authorities.

In an earlier interview with Mr. Wallace, in March 2016, Mr. McConnell argued that the Senate should refrain from considering nominees both in a presidential election year and when different parties control the White House and the Senate. "

Chris Wallace: "Maybe I have this wrong, but when you blocked Merrick Garland's nomination from President Obama, you basically said that we don't do this in a presidential election year and that we wait until the election and then whoever the people choose, they get to pick the Supreme Court nominee.

But what you just said now was it's a question of whether or not it's the party in control of the Senate is different than the president. The question I guess I'm getting to here is, if Donald Trump were to name somebody in the final year of his first term in 2020, are you saying that you would go ahead with that nomination?"

Mr. McConnell: "Well, I understand your question. And what I told you is what the history of the Senate has been. You have to go back to 1880 to find the last time a vacancy created in a presidential election year on the Supreme Court was confirmed by a Senate of a different party than the president."
