Senate Republicans voted to confirm President Donald Trump's Supreme Court nominee Judge Amy Coney Barrett on Monday, a major victory for the President and his party just days before November 3, that could push the high court in a more conservative direction for generations to come.

73% chance of a Dem Senate in this election.

Looking forward to seeing the Dem payback, when the opportunity arises.

The Senate GOP has made it clear there are no norms any more. You don't have to give a president's nominee a hearing. You don't have to hold open a seat when a justice dies during an election. You don't have to live by the standards you set as recently as four years earlier.

So you don't have to leave the court at nine seats either.

Since there are no norms, there's nothing stopping Democrats from adding two, four or six justices next year if they control the White House and Congress.

Not only is it significant, it is THE obstacle sitting in Democrats way. Feinstein better resign ASAP. I'm tired of her 'old school Democrat' ways. This is a new world, a new political environment. Trump made sure of that and Republicans fell in line.

Time to adapt and purge the old guard.

The no vote by Collins was probably okayed by McConnell knowing he had enough votes for Justice Gilead.

Sen. Collins, always willing to take a strong stand when it'll make absolutely no difference.

Otherwise she will furrow her brows and tell us that she is "concerned" as she rubber-stamps anything and everything the GOP wants to push through while she shields a felonious President.

It makes a difference to her - she's trying to show independence from Trump/McConnell on a last ditch effect to save her seat.

After Kavanaugh, it won't be enough, but at least she kept her word. Murkowski sure didn't, though that shouldn't be a surprise either. The only standards the GOP has are double standards.

The far Reich SCROTUS will force Dems hands. As soon as SCROTUS rips away healthcare from millions of people, Dems will recognize that no matter how popular the piece of legislation, no matter how big the vote in favor, or how carefully crafted it is, this radical SCROTUS will take up any lunatic challenge if it meets their objective of a conservative Christian theocracy/oligarchy where all money flows to the top. Next, they'll be coming for your birth control, and I expect that even Social Security and Medicare (if they survive thanks to Dotard) will be in front of the court in a few years.

I don't recall who wrote it, but I read a column recently that was spot-on. I've long believed that the reason the GOP was working like meth-crazed weasels to re-make the courts at the expense of everything else is because they recognize that they are quickly becoming forever a minority party and this is their last gasp to hold onto some semblance of power. The column opened my eyes to the idea that the courts will actually push our government further Reich, because they are willing to make rulings that will destroy popular programs where elected officials were not willing to make those same uncomfortable votes, ACA is a prime example.

If Dems are serious about climate change legislation, about a $15 dollar minimum wage, about a public option, about preserving Medicare and SS, about congressional subpoenas having the force of law, this craven move by the GOP will force the Dems to act. Early in this next legislative session, they will have to re-balance the courts because they are tilted so far to the Reich that even moderately liberal laws, programs or pieces of legislation will not survive SCROTUS scrutiny!

Multiple Democratic senators threw down the gauntlet today during the ACB debate. Basically, the general tone was to tell the GOP that payback is a particularly vicious female dog - and for them to be prepared to reap what they sowed.

And this was Angus King, Chris Van Hollen and Chris ----- that I'm talking about, not Bernie Sanders or Elizabeth Warren. They all told the Republicans that the days of them playing by one rule and demanding that the Democrats play by completely different rules are over if/when the Democrats take over power again.

Now all we need to do is win a majority of seats and the White House after next Tuesday and hold their feet to the fire. The more this is shaking out, the less I think you'll find of any Democratic senate opposition to any substantive changes regarding federal judges at all levels. The only ones I see opposing a unified movement would be Manchin and maybe Tester, but Tester's no dummy - he knows what the GOP has done over the last 12 years.

Feinstein will not stand athwart any movement imo, but she still needs to retire.

The Court needs to be expanded anyway and it needs to be done in a way that combats the push to politicize the courts.

If so, even if there aren't opportunities on the SCOTUS then what about the lower courts?

Obama would make a nice justice.... oh, and Barack, too.

Also Hillary and Pelosi, while we're at it, just to really piss them off.

I'm thinking 42 would be a good number of justices. We can werk in Mayor Pete and AOC that way.

Besides, the number 42 is the "Answer to the Ultimate Question of Life, the Universe, and Everything", calculated by an enormous supercomputer named Deep Thought over a period of 7.5 million years.

People are literally standing in line voting and the Republicans are putting this on SCOTUS. We're on track for 100 million votes before Election Day.

Democrats need to:
Stop pretending that the "republicans" would ever play "fair" or have any sense of "honor" or have any "better nature." They don't.
Flip the Senate.
End the filibuster.
Wipe out almost everything Republicans have done.
Consider impeaching incompetent right-wing "judges" that never should have been appointed.
Add more justices to SCOTUS.
...

The Supreme Court was already saying state courts had the discretion during the pandemic to restrict voting but had no discretion to expand voting.

They are going to use pretzel logic to allow two sets of rules -- one for Republicans in power and another for Democrats.

Expand the seats on the Supreme Court
Expand the seats on Appellate Courts
Expand the seats on all the courts.

It's time that every court start with at least 20-50 judges. This way, one judge doesn't decide a case. There should be a number of judges that are equally taking a side on every issue. This way it's fair.

No one should have their case heard by 12 jurors or a judge. It should be more like 50 jurors and at least 20 judges.

It's not fair using these smaller numbers - or even one.

Jurors should be determined by political affiliation. So should the judges. There should be a litmus test for jurors and judges so we have have a split even review of every court case.

Twelve jurors or one judge may lean the wrong way.

I expect a Democratic Congress and White House to go big. I don't know if they will go big enough to expand the Supreme Court, but if they don't SCOTUS will have its boot on our necks for decades.

#52 | Posted by rcade at 2020-10-27 05:26 PM | Reply

I've heard Dems talk about everything from adding 4 seats to adding eleven seats. The latter would make SCOTUS like one of the Courts of Appeals. Judges would be assigned to cases via lottery, so nobody would know the makeup of the panel until after the lots are drawn. I like this idea. It makes SCOTUS much less of a political football, since one or two hard left or Reich wingers will have much less influence on the court's decisions. That way, the fever swamps in red states will be less likely to make obviously bad policy just so they can force a vote in an effort to take down policy they don't like such as ACA or Roe in front of a Reich Wing court.

The lower courts will also have to be increased by about 30% to water down the Dotard/Moscow Mitch effect.
