A federal appeals court on Friday handed another loss to the Trump campaign's effort to undo President-elect Joe Biden's win in Pennsylvania, with a judge -- one of Trump's nominees -- writing that the campaign's "claims have no merit." In a 3-0 decision, the US Court of Appeals for the 3rd Circuit rejected the campaign's effort to get a do-over of its lawsuit challenging the election results in Pennsylvania, which a lower court had already tossed out last week. "Free, fair elections are the lifeblood of our democracy. Charges of unfairness are serious. But calling an election unfair does not make it so. Charges require specific allegations and then proof. We have neither here," Judge Stephanos Bibas wrote in a 3-0 decision from the US Court of Appeals for the 3rd Circuit.

I'm not saying that he has a chance in hell, just that Trump needed at least one case to be sustained by an Appeals Court before he could petition the Supreme Court to hear his case. Now, I fully expect them to turn him down, but he needed a case like this before he could even try.

But it wasn't sustained. It was kicked out.

Now Trump thinks he can call in his markers from his appointments to U.S. Supreme Court to win his case.

It's the nature of the beast. Trump assumes everybody is as crooked as he is.

Because trial and intermediate court's of appeal have no choice. If a case within their jurisdiction is filed the court must consider it. The USSC, and most if not all state court's of last resort, have discretionary jurisdiction, they can choose not to hear a case.

Now, I fully expect them to turn him down, but he needed a case like this before he could even try.

His lawyers could not have engineered a poorer vehicle to try to get there. The sole and only issue brought before and decided by the Third Circuit is whether the district court abused its discretion by denying leave to file a second amended complaint. That is the sole and only issue that can be brought before the USSC. Not fraud, not evidence, not Equal Protection, not Due Process, not the Elections Clause, the only issue is refusing leave to amend.

That is such a mundane procedural issue that I can't imagine any SC Justice giving a d**n about it, much less four.

Neither will Mitch McConnell and the GOP wing of the U.S. Senate.

They still have the midterms (and the Revenge of Trump's twitter finger) in 2022 to worry about. Moreso if Georgia takes two Democrat seats. 2022 will be more Live or Die than 2020 with 34 out of 100 Senate seats being up for election to a 6-year term.

If they don't fight Biden tooth and nail, they'll be crucified by Trump, (the New York State Attorney General not withstanding.)

If you haven't figured it out by now, Trump wasn't supported by the RNC because he was "presidential material."

The RNC had a much more nefarious job in mind ~~ one that suited an amoral actor like Trump to a "T." Had they known in advance that Trump was in the waning phase of mental instability, they might have made another choice.

But too late came sooner than they expected. As a result Trump failed to carry out the RNC's plan to destroy our current democratic form of government and replace it with a one party rule authoritarian government. Trump was so unstable he never even made it to second base (a second term).

Bingo! People often say that the repubs are afraid of Trump's base and that is why they are not condeming him. I don't think that is necessarily the case. I think it more likely that Trump is saying and doing the things in the open that repubs really want but didn't have the guts to do it.

I am reminded of a speech that Bill Barr gave months ago where he spoke of the 2020 elections being the last chance that America had to avoid having a socialist government. I didn't get the impression that he was speaking talking points. He and many other repubs really believe it and therefore they willing to subvert democracy to avoid a Biden presidency.
