Drudge Retort: The Other Side of the News
Friday, December 11, 2020

The Supreme Court refused Friday to let Texas challenge the election results in four battleground states critical to President Donald Trump's defeat at the polls last month, likely sealing his political fate.

"The State of Texas's motion for leave to file a bill of complaint is denied for lack of standing under Article III of the Constitution. Texas has not demonstrated a judicially cognizable interest in the manner in which another State conducts its elections. All other pending motions are dismissed as moot. Statement of Justice Alito, with whom Justice Thomas joins: In my view, we do not have discretion to deny the filing of a bill of complaint in a case that falls within our original jurisdiction. See Arizona v. California, 589 U. S. ___ (Feb. 24, 2020) (Thomas, J., dissenting). I would therefore grant the motion to file the bill of complaint but would not grant other relief, and I express no view on any other issue." www.supremecourt.gov

Apparently Alito and Thomas have no problem doing "irreparable damage to the Court."

As you said, Et Al "(o)f all the cases to come before the Court this one really needs to be unanimous harm to the Supreme Court."

What a shame it wasn't.

#5 | Posted by YAV at 2020-12-11 07:02 PM | Reply | Newsworthy 5

Thomas and Alito voted to hear the case on grounds of original jurisdiction only (the SCOTUS has to adjudicate issues between the states), they did not agree that the case had merit - as least as I understand it.

As a matter of the legal issue itself, I understand that the decision was unanimous. But it is quite telling that none of Trump's appointments even agreed with the jurisdiction stance of Thomas and Alito. Trump rightly got shutout.

But again, this is not over. The GOP will continue to dispute the Electoral College results when they're brought before Congress on January 6th, putting pressure on all of Trump's supplicants to reject the slate of electors. They are not giving this up until the actual finish line is crossed on the 6th and they'll continue to declare Biden's presidency as tainted by illegitimate voters as long as Trump keeps up with the same false unfounded allegations.

"I would therefore grant the motion to file the bill of complaint but would not grant other relief, and I express no view on any other issue."

What exactly does that mean?

OK, that was strange how "harm to the Supreme Court" got stuck in there. The actual quote is:

"Of all the cases to come before the Court this one really needs to be unanimous."

Mea culpa.

"Of all the cases to come before the Court this one really needs to be unanimous."

As I'm thinking about it, the dissenting opinion seems to say that he would have consented to hear the case but that he would have voted against Texas if they did hear it. So it essentially is unanimous. Am I misunderstanding that?

#11 | Posted by Hagbard_Celine at 2020-12-11 07:06 PM | Reply | Newsworthy 1

Unanimous with respect to the final outcome that is.

#15 | Posted by Effeteposer at 2020-12-11 07:09 PM | Reply

What exactly does that mean?

It means that even if leave to file had been granted, he would have denied any relief on some unknown grounds, probably standing.

In terms of relief and effect the order is unanimous. To me, the better approach was to grant leave to file and immediately dismiss the case for lack of standing. That is where we end up but with statement of Alito and Thomas about mandatory original jurisdiction.

"The Supreme Court has decisively and speedily rejected the latest of Donald Trump and his allies' attacks on the democratic process," campaign spokesperson Mike Gwin said.

He added: "This is no surprise " dozens of judges, election officials from both parties, and Trump's own Attorney General have dismissed his baseless attempts to deny that he lost the election. Found this nugget in r/DonaldTrump on Reddit:

joinedfor_TheDonald
I don't get this stupid statement, Trump can run in 2024...for what? To be cheated again? Another rigged election? More illegal votes? Wtf does it mean run in 2024....We can't hold anything anymore, elections won't matter, voting won't matter, protests won't matter, if Biden gets in then democracy is lost. The presidental seat was confirmation that they can cheat at a national level and get away with it. The house and the Senate are next. The Demoncrats have infiltrated where it counts. It doesn't matter who votes or how many votes a candidate gets, what matters is the people counting the votes, which let's face it we've already seen is --------.

This is dangerous and not uncommon on the conservative threads of Reddit. They've quite literally lost all sense of reality and belief in American democracy. I thought today's ruling would be something to celebrate; these posts are sobering me up.

I understand it's a microcosm in the big picture, but these posters were right in line with the OAN and NEWSMAX watchers, the hard core righties that are against Fox News now. They seem at LEAST as prominent as the Tea Party folk, but at least the Tea Party folk still believed in the democratic process. I dunno, this just doesn't feel right. They don't seem right. It's a mass delusion that I'm afraid they will never recover from.

I think Biden would let them go. Many would think that's the smart play in the long run, let them drown in the tiny GDP that Republican states put together. And then I look at Oracle moving to Austin. Makes me wonder what sort of amazing perks Texas and the like would throw around to attract the big players, especially out of Silicon Valley.

My favorite read of the evening on how the events unfolded (from dailykos.com)... quote...

"The U.S. Supreme Court has refused to take part in Donald Trump and the Republican Party of the United State's coup attempt despite a final round of frivolous unicorn poop and pixie dust briefs from, including and I am not making this up, "New California State" and "New Nevada State." (Alternately, "New Nevada Sate" because spelling is optional in the new civil war.)"

Dumb stuff. Dude lost, he's a very bad Lewser.

No proper home training, bad sportsmanship.

What a pathetic, weak, lost soul this "man" is.

I have nothing but contempt for him and his enablers. The Republican party is a faction, they are past reasoning with. Open conflict is the most honest and straightforward approach to these --------.

Trump is apparently contemplating asking AG Barr to appoint a special consul, with an unlimited budget and with no defined time limit, to open an investigation into the 'fraudulent 2020 election' as well as an investigation into Hunter Biden and his family. If the AG does appoint a special consul, the law covering that would assure that it would outlive the Trump administration, meaning that Biden would have to allow the DOJ to continue the investigation. I suspect that Trump thinks that if the special consul finds any evidence whatsoever of even the slightest hint of problems with the election that he will be able to go back to the Supreme Court and demand that they retroactively award him the election. And if that doesn't work out, he's hoping that the special consul will dig-up enough 'dirt' on Hunter Biden, and indirectly on Joe Biden, that he can destroy the Biden presidency, thus making way for his triumphal return in 2024.

LOL. He'll stoke out before Easter.

Trump: "This is the big one."

It sure was ~ and it was a pleasure to watch.

That was one hell of a political IED Donnie put together.

It went KA-BOOM right in his lap. (where his "widdle winky" lives)

The Republican Party would have to be pretty stupid to put all their eggs in that basket(case) again.

"(Trump'll) stoke out before Easter."

That's the one and only way the Republicans will escape the death grip Trump has on their entire party.

I've been thinking that this Supreme Court case had more than the stated agenda.

I appeared to me this was also the opening salvo of the Republican Party to use a Supreme Court decision to set a precedent for the future annihilation of states sovereignty ~~ which would be a necessity under a autocratic/dictatorial/Unitary Executive leadership.

If so, America dodged more than one bullet.

If McConnell had a soul, he'd be eating some crow about now.

He did everything he could to make Obama a one-termer. ~~ FAIL

He did everything he could to make Trump a two-termer. ~~ FAIL

Wow just checked out Trump's twitter feed.

Apparently they're "only just beginning to fight!"

I'm betting escalating, increasingly desperate flailings from Trump, some of which will likely result in violence against perceived "enemies of the state."

Congrats, Repubs! You've drug our country down to "approaching failed state" status, all in the name of making America "great again."

Annnnnnd...."states' rights" is yet another GOP talking point sent off to die.

"You think there's still a shred of intelligence left in that cult?"

I'm saying the RNC has four years to figure out where they went wrong and not do it again.

Trump's loss was a huge blow. It should be obvious to even them they wasted a lot of time, money and credibility on a born loser. Also that he's not the sharpest tool in the shed.

I agree that Trump stirred the pot. That was just for openers. He failed to get a second term to advance the mission and piled a lot of baggage on them and himself in the process ~ mainly his handling, or lack thereof, of a national pandemic crisis.

That's not a good look for Republicans who wants to convert the U.S. to a Unitary Executive.

Trying to cover his incompetence by means of the judicial system didn't help either.

I wouldn't be so focused on the person.

This was about figuring out a method. And they did.

Trump probably won't be a live in 2024, so his reelection campaign is really just a conduit to keep fleecing the rubes.

2024 will be similar methods but with a more refined front man and polished methods that don't feel as crass as Trump.

I have zero hope that the GOP will come away from this experience thinking they need a new line of approach.

I agree.

I agree, they have shown their true colors more than a pride parade.

And face it, most of them would try to kill us off literally if it was codified as policy.

It's not unreasonable to marginalize them like they deserve to be.

It's time to create a second class of citizens and see if it happens to them, maybe they will understand. As it is the only way they ever learn.

I'm afraid they don't want to learn. They only want to try harder the next time.

Some would learn.

The majority would just integrate the experience into their victim complexes.

I'm awaiting the day Republicans admit they tried to cheat in the elections while accusing Democrats of cheating in the elections.

"We know the Democrats cheated in these elections because we cheated in the elections and lost," said Trump.

Oh well... I'd rather think they are victims then be their victims for real.

They had their chance... and you see what they did with it.

Elections have consequences. I was the first person to reach across the aisle after the election and you see what they have become.

Sad sad pathetic small barely-evolved self-deluded souless fascists.

And Bill is probably one of the smarter ones.

Anyone read Trump's twitter replies? There are zealots who worship him. The made-up ideas from nomads to make sense of the world..aka religion, is part of their identity. In our mistake shaming culture, nobody gives up who they are right away.

No, it goes back farther than that. They weren't what you'd call "receptive" even when Bill Clinton was President.
