Florida Agriculture Commissioner Nikki Fried says she will disregard Gov. Ron DeSantis' order to lower Florida flags at half-staff in honor of conservative talk radio host Rush Limbaugh who died last week.

Go Nikki! To lower our flags for that piece of filth would be disgusting. He was a vile human being and I, for one, and quite glad the piece of filth is dead.

Although I personally agree with her, what does the law say? As a government official, she doesn't get to pick and choose.

Which just serves to underscore he protest against DeSantis's ridiculous and wrong headed honor for that piece of filth Rush Limbaugh. OK, he's dead now. Great! He insulted millions over his vile career. A disgusting piece of filth like that should be dishonored not honored. When Donald Trump awarded him the Medal of Freedom previous recipients threw theirs in the garbage. He was a despicable human being and no amount of awards, etc. can change that. Hey, need drugs??? Have your housekeeper go get them for you. The worst of the worst. Vile filth.

#9 - The Florida Law states:

256.015Display of state flag; protocol."
(1)The Governor shall adopt a protocol on flag display. The protocol must provide guidelines for the proper display of the state flag and for the lowering of the state flag to half-staff on appropriate occasions, such as on holidays and upon the death of high-ranking state officials, uniformed law enforcement and fire service personnel, and prominent citizens.
(2)The Governor may adopt, repeal, or modify any rule or custom as the Governor deems appropriate which pertains to the display of the state flag.

The argument offered by not just Nikki but a lot of other State officials is Limbaugh does not qualify as a "prominent" citizen. He's infamous, divisive, and exactly what was not intended when "prominent" citizens was included in the wording of the law.

The second part of the law seems pretty clear. As much as I dislike DeSantis and Limbaugh, the Governor pretty much has the say here, legally.

Although, on second reading, the law you posted only seems to apply to the state flag. No mention of the US flag.

#12 - It's a subtlety that's being missed and I'm really glad you caught it. The Governor, despite the breathlessness of some of the news stations here in Florida only has authority over the State Flag in Florida. He has no authority over the flag of the United States, which falls under Federal jurisdiction. People may search the law I cited in #10 for verification, however there is only one section that pertains to the Governor of Florida's ability to lower the flag and that section only pertains to the State flag.

What's going to be interesting is to see if we see a split on the flag - with the FL flag half mast and the flag of the United States at full mast at some point. Right now the United States flag is at half mast due to 500,000 deaths from COVID-19 (Biden's order):

So both flag might be lowered, but given the timing, it will just be coincidental or compliance by some Republicans in positions over Departments that will abide by an illegal order on the part of the Governor.
