That's actually a legitimate complaint. No one should be forced to live in conditions like that.

Jail conditions in the United States are appalling. Sure, this guy absolutely should be locked up, but lots of people in jail shouldn't be there, and are held simply because they don't have the money for bail. Overcrowding, poorly maintained jails, and deliberate efforts by jailers (the best known example being Arpaio) actively making deliberate efforts to make conditions worse have lead to thousands of American jails that should qualify as cruel and unusual punishment.
