Why is Biden's Justice Department arguing for the dismissal of E. Jean Carroll's defamation claim against Donald Trump? Because the issue of limiting liability of federal officials in future claims goes well beyond one president or even all presidents.

Fat Nixon's remarks had nothing to do with official government business. In fact most, if not 99.999999%, of federal officials have the brainpower to parse their comments in a way that will not cause a lawsuit.

That's pretty much what I thought as I read the article. Fmr Pres Trump is no longer in office, so no longer protected by the DoJ's precedent of not investigating and/or indicting a sitting President.

But that should not give sitting Presidents a bye for any crimes they may commit while in office.

The author seems to try a lot to justify the decision, but I'm not really buying what he is selling.

The accusation stems from Trump's behavior long before he was in the White House.

Defaming somebody he is credibly alleged to have raped in the past is NOT presidential speech. There are ways to deny the accusation without defaming her, that's the basis of the lawsuit. DOJ has no business being a part of this case, or the insurrection case. It used to drive me nuts when Hanutty and other GQP mouthpieces used to give President Obama grief for his sometimes halting speech pattern when he was making comments off the cuff, and wanted to get the language exactly right, but THAT'S PRESIDENTIAL! Understanding that as POTUS what you say has meaning, not just in this country but around the world, your words can spike or tank the markets, can help or hurt our efforts overseas and at home, that's presidential. That's why electing somebody who shoots from the lip, and then doubles down when called out on his toxic language is so damned dangerous, and why we should never again "elect" an intellectually lazy, mentally unbalanced, moron to higher office.
