Also interesting is how the petitioner (defendant?) - the guy who has been in Gitmo for 20 years - is not allowed to speak in court of his experience in the system.

It is interesting that the government is not really saying that it is "secret", but rather that they promised the Polish government they would never authorize it's release. From the government's point of, the national security interest exists within the need to follow through on agreements with foreign allies.

Sure everyone knows Area 51, Groom Lake, is a classified base,
but the base itself is common knowledge and known (and thus would
fall in the Supreme Court's definition), its what is
actually on/in it that is speculated at. Aurora?
Little Green Men? That's the classified/above top secret part.

A well known or acknowledged fact by everyone who is sane in
the world.

Poland knew or should have known that any such agreement to enable torture on Polish soil was illegal, and the word of any government official guaranteeing its secrecy could not be relied upon.

And Poland is subject to the International Criminal Court. Torture is a crime under international law. Prosecute them.
