Teri Kanefield: Trump isn't afraid to file a lawsuit, even one he could lose. But his lawyers would be wise to advise against it this time.

More from the op-ed...

...Last week, former President Donald Trump said he will "defend executive privilege" in an attempt to withhold documents from the House committee investigating the Jan. 6 insurrection. Also last week, President Joe Biden rejected Trump's claim that privilege should apply and authorized the White House records housed at the National Archives to be released to Congress. This suggests we may be heading to the courts....

Trump is trying to claim that he has final authority over whether those documents can be released. But a statute Congress passed in 2014 specifically gives the final say over executive privilege (at least in the executive branch) to the incumbent president. Trump, while president, had the opportunity to try to shift the power to former presidents but made no such attempt. (Not that Trump worries about making inconsistent arguments, but while he was president he also continually argued in favor of the so-called unitary executive theory, which states that the president has complete control over the executive branch. That, now, would be Biden.) ...

This entire argument is wrong, a former President should have no more right to hide his actions while President than any other citizen has to hide their action in any previous employment, he should actually ave less right to do so considering he is our employee and his actions affect every one of us. Protecting his reputation from the stupid things he did or tried to do should be on the front page of every newspaper in Amerca. He was the President and we have a rimes he committedght to know about everything he did in that role and this "Executive Privelege" nonsense is just a phony attmpt to cover up the crimes he committed. We are burdened by a politicized Supreme Court which Biden should have already started expanding to reduce the power of the crazies Trump has appointed, that is the area where Biden is failing us. We need a bold leader not a weak, get along, type of President. Get busy Biden, before the Fascists take over because once they do it will be far too late and millions of us will point our fingers at you for letting it happen.

Trump will file suit. Doing so suggests only that he is a strong, fighting guy not to be messed with, just as that prancing queen Roy Cohn taught him. Trump's filing will request a slow-walk to 2023, in hopes of being able to run out the clock on the current session of Congress. The Select Committee will ask for an expedited ruling, and the Biden Administration should concur.

Get this thing settled, get the committee revved up, and bring this matter to completion before the next election, since if the 2022 mid-terms go as history suggests, the GOP will take Congress and shut down the committee...
