A judge on Friday denied a last-ditch effort to dismiss a criminal case against actor Jussie Smollett, who is accused of lying to police when he reported that he was the victim of a racist, anti-gay attack in downtown Chicago in January 2019.

...An attorney for the former "Empire" actor said Smollett's rights were being violated since he had already performed community service and given up a $10,000 bond under a previous deal with Cook County prosecutors to drop charges.

"A deal is a deal. That's ancient principle," attorney Nenye Uche said.

But Judge James Linn noted that Smollett's case now was being led by a special prosecutor appointed by another judge, an arrangement that he would not upset....

Obviously he was handled with kid gloves, but I've never liked these types of prosecutions that run afoul of the concept of double jeopardy.

Why wouldn't the SP be required to live by the deal signed by his government? It just seems every deal could be unilaterally negated by switching prosecutors.

I don't like the initial deal, but I like reneging on it even less.

Bingo.

The original deal was a free pass, imo.

However, when you come to an agreement within the legal system, that agreement must hold fast[1]. Period. Full stop.

Our legal system needs to be deterministic. It cannot be random.

1- my only concern here would be the sunlighting of new evidence. Such new evidence would need to be scrutinized and treated appropriately. However, I am not aware of anything new in the case in discussion.

I do not necessarily believe Smollett committed felony behavior. But it certainly was misdemeanor criminal behavior and he has richly earned the mockery and derision that would accompany such a conviction.
