Prosecutors or defense attorneys would have to ask Judge Bruce Schroeder to inform jurors as they begin deliberations that they could consider finding Rittenhouse guilty of lesser charges rather than the original counts. The judge would then have to weigh whether the evidence the jury had seen supports those lesser charges before instructing the jury to consider them.

"He's got nothing," the former assistant D.A. said. "I just don't understand it. What are we doing here? We're all kind of scratching our heads."

Adams said Binger will "100%" ask Schroeder to include lesser charges in the jury instructions, most likely second-degree versions of the homicide and endangerment counts.

[...]

But Binger has already "muddled" the case with multiple charges and asking jurors to consider even more counts risks confusing jurors further, another former D.A. said.

"As a prosecutor, you charge more counts than necessary because you don't have a strong case," he said. "You know the old saying, throw as much as you can against the wall and see what sticks. It's confusing for me. Imagine what it's like for the jury..."

And yet look at all the people supporting this prosecutor, purely because of their political biases. And they justify their behavior by pointing out the fact that *some* people support Rittenhouse for the same reason. It's like a really dumb game of football to all of them.

- purely because of their political biases.

Assigning motivations... is still a logical fallacy. And still really dumb.

#3 and it's the go to move on this site.

Back when Bush and Obama was first running this site used to have some actual debate, interesting points of view discussed, and legitimate conversation.

Now it's just a Troll like echo chamber assigning positions and partisan side taking.

Well, it's also a feature of fascism, and fascism has taken hold of the GOP.

Like when Trump said the press is the enemy of the American people.

He's assigning motivations because of his political outlook.

There's a lot of monkey see monkey do in politics.

Remember those Unite The Right marchers in Charlottesville who were wearing Trump khakis and Trump white shirts and Trump maga hats? Best understood as a cosplay event where everyone dresses up like their favorite superhero.

"Now, prosecutors say they plan to ask the judge to allow the jury to consider lesser versions of at least two of those charges: those related to the shootings of Huber and Grosskreutz."

"Both men ran after Rittenhouse as he was attempting to run toward police after shooting Rosenbaum. Multiple videos and photos show Huber striking Rittenhouse with a skateboard, and Grosskreutz testified that he believed Huber was trying to harm Rittenhouse.

"Grosskreutz was himself armed with a loaded pistol. In testimony Monday, he acknowledged that his gun was pointed toward Rittenhouse at the moment he was shot..."

"Using an illegal weapon"

The weapon wasn't illegal. KYLE was illegally carrying it.

"The weapon wasn't illegal. KYLE was illegally carrying it."

So? That's not why he was attacked. And again, it does not invalidate his self defense claim under the circumstances.

Kyle: I was just minding my own business and people started attacking me. I was just being a Sentinel.

I think Visiter made your point more eloquent. How can they convict that cherubic face.

Much derogatory comment has been made on this site about the conduct of the judge. I wonder if it is as visable to the jurors as it is to us outsiders, and if it is, is jury nullification due to judicial conduct possible? I'd never thought before about throwing out a trial because of the judge.

"Grosskreutz was himself armed with a loaded pistol. In testimony Monday, he acknowledged that his gun was pointed toward Rittenhouse at the moment he was shot..."

Yet moments earlier Kyle pointed his loaded rifle at Grosskreutz when he had his pistol in one hand by his side and and was not shot. To some in the crowd imho Kyle was an active shooter.Their actions were more attempts to stop the Shooter fleeing and harming others.Kyle committed homicide and did not want to get hurt.Fleeing shooters shouldn't be able to claim self- defence against the crowd once they have decided its time to retreat.

"Fleeing shooters shouldn't be able to claim self- defence against the crowd once they have decided its time to retreat."

Retreating from a crowd that's attacking you invalidates any self-defense claim? Do you realize how stupid that sounds?

I remember working at the Tudor Inn in Cloverdale B.C. many years ago the Young Americans would come across the border to drink underage. Every time one started a fight and was getting his ass kicked he would yell for his buddy to grab the gun out the car. They were also surprised when the crowd jumped them instead of waiting to learn their intent.

Are you talking about this group here?

What is your point here? Are you claiming that Kyle initiated a fight?

I watched the trial the crowd was not attacking Kyle to kill him as you imply,Grosskreutz could have shot Kyle with his pistol from 20 ft away once Kyle had pointed the rifle at him but instead tried to run up and grab him with his empty hand. They were trying to grab the coward.

"I watched the trial the crowd was not attacking Kyle to kill him"

It is not necessary to prove the crowd was trying to kill him to justify self defense. At that point, Kyle had just been bludgeoned with a blunt object by one of his assailants, which could have killed him even if it was not intended to.

"Grosskreutz could have shot Kyle with his pistol from 20 ft away once Kyle had pointed the rifle at him but instead tried to run up and grab him with his empty hand."

Kyle could have shot Grosskreutz when he was 20 ft away, but instead he waited until he was absolutely sure Grosskreutz posed an imminent threat. Likewise, Kyle could have shot Rosenbaum at any time during their several encounters that night, but did not do so until Rosenbaum was also literally upon him.

Rosenbaum, Huber and Grosskreuz all chose to be vigilante assailants that night. It's possible that Grosskreuz merely intended to disarm Rittenhouse without hurting him, but he sure as hell sent mixed messages by pointing a gun at him while doing so and did nothing to differentiate himself from Kyle's previous two attackers as far as I can tell.

"They were trying to grab the coward."

The way you're describing it reminds me of a game some kids used to play in primary school. They called it smear the ----- (although none of the kids kids really knew what that meant).

Vigilante assailants. I think that's how Saudi terrorists viewed those who tried to break into the cockpits to stop them on 9/11 .

#18 | Posted by Scotty at 2021-11-14 12:59 AM | Reply

So now you're equating Kyle Rittenhouse to a 9/11 hijacker. Do you realize how stupid that sounds?

#19 | Posted by sentinel at 2021-11-14 04:36 AM | Reply

Being an illegal hijacker doesn't negate a self defense claim.

No I'm pointing out the absurdity of labelling people vigilante assailants for attempting to stop violence against themselves.

SS pedo still defending a murder?

Give Kyle Rittenhouse a Swastika flag and Sentinel will swoon.

No, you're just plain lying, Scotty. You you very well that none of the people Rittenhouse shot were attempting to stop violence against themselves. The videos and testimonies all contradict that absurd claim.

All you got are lies in hopes of defending a murderer.

The first person Rittenhouse murdered scared him.

The second person Rittenhouse murdered was attempting to take down an active shooter.

The third person Rittenhouse shot was responding to an active shooter.

All you got are lies.

Because you and Rittenhouse are both Nazi wannabes.
