Jennifer Rubin: The current 6-to-3 right-wing majority seems poised to wreak havoc on the Constitution as it has been understood for decades. One can practically hear the justices champing at the bit as they review cases this term.

What legitimacy? 5 of the 9 members were appointed by presidents who got fewer votes than their opponents.

The electoral college destroyed the supreme court's legitimacy, after it destroyed congress' legitimacy, trump's legitimacy, and bush's legitimacy.

Yeah. I think that boat has already sailed. In the minds of most Americans the Supreme Court justices are just another species of political animal. "Legitimacy" does not enter into the equation. Sadly, once upon a time, prior to Ronald Reagan that was not always the case.

The 'legitimacy' argument was lost when the 'originalists' argued in favor of greatly expanded gun rights, in the face of clear writings by Madison, Hamilton and Jay in the Federalist Papers...

Here is what some folks are predicting round 2 is going to look like:

Brynn Tannehill
@BrynnTannehill

I'm telling you now how this is going to go down:

About a week after the decision to overturn Roe is released, AG Paxton in TX will release an opinion that TX is not bound by Obergefell. 1/n

Within days, Abbott will issue an executive order instructing clerks not to issue new marriage licenses to same sex couples.

He may or may not instruct state officials to cease honoring existing licenses for same sex couples. 2/n

There's likely to be some language about determining legality of marriages based on sex listed on original, un-amended birth certificates.

State courts will affirm legality of Abbott's actions in light of Jackson's Women's Health decision. 3/n

They'll probably win at the District Court level. Regardless, it will get appealed to the 5th Circuit, where Abbott will win, 100% guaranteed. Whereupon it ends up in front of SCOTUS, which has already signaled they regard Obergefell as being on unconstitutional grounds. 4/n

We will see Obergefell die in 2024. The Alliance Defending Freedom (ADF) has been planning this ever since it became apparent that Roe v. Wade was going down. Most conservative state AGs have relationships with the organization. 5/n

I have specific intel that this is the plan for how to expedite the destruction of Obergefell starting in early to mid-July. The official release of the decision starts the clock ticking.

It is unknown when they will begin targeting Lawrence.

Cassandra has spoken. 6/n

According to the above tweets' author, who claims to be a:

The answer is:

"You're a fool if you plan on anything else happening. It's like buying a house based on your hope that the lottery ticket you bought hits the jackpot.

The odds of these not happening are so low as to be trivial."

Wow, not good, not good at all as Lamp likes to say. It seems like there are a lot of anti-gay laws still on the books across this country:

When Roe v. Wade is officially overturned, abortion will become illegal in 20 states immediately.

When Obergefell is overturned, same sex marriage will become illegal instantly in 32.

When Lawrence v. Texas is overturned, being gay will become illegal (again) in 12.
twitter.com

States across U.S. still cling to outdated gay marriage bans
Same-sex marriage became the law of the land in 2015, but you wouldn't know that looking at the constitutions and statutes of dozens of U.S. states.

I did some digging, and apparently the criticisms of Obergefell v Hobbs and Lawrence v Texas in Alito's draft directly mirror what the guy who drafted the Texas abortion ban said in his amicus brief on Dobbs (source below)

Well, let's start with the assumption that ------- is a traitor. The argument could be made (and should be made) that all of his appointments are invalid. Throw his 3 justices off the SC and get 3 new ones. Hear Thomas complain? Lock his wife up for conspiracy to overthrow the government. How would that simple act have impacted this decision?

Don't want to be soooo aggressive? Well, non-stop hearings would have spotlighted the republican insanity and maybe, just maybe discourage Abbott and DeSantis from making radical moves they have made, thus impacting the SC's perceptions on what they can get away with.

Again, we are at war, it seems only some of us are aware of it.

"Fight back!"

Happy to.

But I'm not willing to shoot myself in the foot, bite my nose off, or admit defeat up front.

But you do you.

Unless you're counting on Covid relief and the infrastructure bill to save us
#57 | POSTED BY TRUTHHURTS

Nope, I never thought policy, unless it was voting rights bills, would save us. I thought covid relief was necessary to help people weather the pandemic, but that was about helping the American people survive during covid.

How? What should Biden, the Democrats in Congress, the American people who don't like what's going down do tomorrow? And the next day? And the day after that?

Holy crap, if this stands, when you combine it with the Jan. 6 hearings, this midterm election cycle is going to be, hmmm, what is the word, cutthroat. Every dem against every member of the insane Republican Party, not just against their policies, but against them.
Could be, in some states, this will be the main decider, and most Americans favor women's reproductive rights.
I used to be pretty middle of the road when it came to fundamentalist churches but no more. The Catholic Church is an undemocratic dictatorship run from a foreign country, the Vatican, against our own Constitution and against American women.

The fascinating truth is that if the American Right fully wins its battle over the rest of us they are going after the Catholics next. Also the Mormons. It shouldn't be necessary to explain why.

It's the American Left that protects these groups from being thrown into the fires with the rest of us.

I have no idea what you are talking about.

America splits into three parts, sort of along the lines of The Man In The High Castle.

The Pacific Coast states become a country. The Northeast becomes a country. The South, Texas, and the flyover states become a country.

"working-class voters who supported Trump did not attend church regularly, making them susceptible to the sense of community in a Trump rally."

JD Vance

I don't think this is about Christianity any more than captain Ahab was just trying to hunt wales for income.

Alito....total partisan hack...zero middle of the road...always leans right
Thomas....partisan hack married to an activist rightwing NUT! always leans right
Kavanaugh...uneducated partisan hack...only reason he was elected
is that he's a 'Rightwing Yes Man'... almost always leans right
Roberts....okay...biggest "?" out of rightwingers on the court.
Gorsuch...may surprise people
Barrett...reports she's an ideologue, but jury still somewhat out...
likely an rightwing ideologue

Welcome to the Divided States of America.

Never thought I would live to see the day.

But here we are.

And we are not even at the endgame folks.

There are lots of rights "not enumerated" that can be taken away.

Elections have consequences. Let Trumpy into power again and standby to standby.

The fact that Republicans care more about removing rights than protecting them is just more proof that the two parties are definitely NOT the same.

Anyway ladies. It's a done deal so guess you will have to "just lay back and enjoy it"!

He literally cites a witch hunter from the 1600's in his
drafted opinion. Repeatedly...

I cannot but hate the Republican Party... everything about them is
retrograde, retarded, anti-education, anti-rights,
anti-freedom, anti-intellectual...
They would keep women barefoot and pregnant and in the kitchen,
they would keep blacks subservient in an Apartheid like regime,
they would strip both of the vote if they could,
they have busted most of the unions in this country,
they coddle and protect the richest amongst us,
giving them tax breaks, giving them perks,
voting for them, and their interests,
they attempted to overthrow the govt when they didn't get their way,
they vote pro-pollution,
they vote pro-war,
they vote anti-earth...

There is literally nothing redeemable about their party.
Only backwards thinking fecks love the GOP...

They are not "risking legitimacy." They're torching it.

Since opposition to abortion and contraception is based on religious grounds, surely any laws that ban them would be unconstitutional as these laws would be violating the rule, the separation of church and state?

Just wait until at home pregnancy tests are prescription only and the test device must be sent to the state or they'll send someone to come knocking on the door..
