Lithwick: 'Justices Are Not Kings'

Dahlia Lithwick: Justices are not kings. They can demand silent reverence, but it is not assured them. There have been plenty of us warning that this relationship was in jeopardy for many years, and the warnings were dismissed as efforts to undermine the court. Today's decision confirms that, if and when the public is finally ready to give up on the court, there will be nobody to blame but the six justices who gave them nothing to believe in.

...The American people's confidence in the Supreme Court is at its lowest level ever recorded, according to a Gallup poll released Thursday [June 23, 2022].

The poll found that only a quarter of Americans have confidence in the court, dropping 11 points from its mark of 36 percent recorded last year. The most recent figure is 5 percentage points lower than the previous lowest point, which was recorded in June 2014.

Gallup has tracked the percentage of confidence that Americans have in the court since 1973. Gallup's analysis states that many institutions have seen a fall in the level of confidence from the public, but the court's decline is about double what most other institutions have seen.

The results come as the court appears poised to overturn the 1973 Roe v. Wade decision on abortion rights. A leaked draft opinion in the spring showed that five conservative justices on the court " three of them nominated by former President Donald Trump " are ready to overturn the ruling.

The ruling, in a case known as Dobbs v. Jackson Women's Health Organization, is expected to be released as soon as the court's term comes to an end.

Gallup found in September that the court's approval rating had dropped 9 percentage points to 40 percent, also a record low. This poll was taken in the aftermath of the court declining to block a Texas law that bans most abortions after six weeks of pregnancy but before the draft opinion in Dobbs leaked. ...

Gallup's analysis concludes that it is unclear if the court overturning Roe would overall harm its reputation further or improve it in the eyes of those who agree with the decision. ...

I find it absurd that we let justices serve for the rest of their lives. I get the argument that lifetime appointments are to protect against the whims of politics, but it's no better to leave such important, long lasting effects on society to the luck of the draw on a calendar. It's bizarre that we allow one president to cash in on the judge lottery just because some random number of old geezers happen to keel over during his or her term in office - or in one of the appointments Trump made, months before it even begins.

You can argue that terms should be long, 10 years or something, but they should not be lifetime. No one is infallible, but appointing them to lifelong terms sure gives that impression.

When you give them lifeyime appointments and the voters no power to reject them then they do become defacto Kings or defacto dictators with a political agenda yjere is good reason to change yje number of Justices on yjr court. Pack yhe court and dillute the power of right wing nuts like Thomas and liar Kavenaugh.

If the belief is that U.S. Supreme Court justices are now "kings," then the solution is to stop voting for the political party that appoints them to act like "kings." i.e Republicans!

The same thing goes for federal judges, congress, presidents . . . and on down the line to each individual state, county or city elections.

The SC has never been disrespected as much as it is today, They all said that the Roe decision was "settled law," That makea the consetvatives on the court nothing more than opprotunist liars. They lied under oath and there are plenty of recordings of them doing it in confirmation hearings when they were specifically aasked about Roe.

The sad part is how many senators were eager to believe them in the confirmation hearing when all evidence pointed to them lying.
