Steve Benen: As Attorney General Merrick Garland wrapped up his brief remarks yesterday afternoon, Donald Trump wasted no time in responding. "I continue to ask, what happened to the 33 Million pages of documents taken to Chicago by President Obama?" the Republican wrote. "The Fake News Media refuses to talk about that. This need not be complicated: Obama worked with the National Archives; Trump worked around the National Archives.

Obama didn't improperly take anything; Trump improperly took several boxes' worth of materials, including highly sensitive national security documents.

There is simply nothing legitimate about this entire line of argument. It's not only insulting to Americans' intelligence, it reeks of desperation.

While I'm generally mistrusting of official government statements I can't think of a reason why NARA would lie about this and what I read in their statement makes sense.

If Obama was guilty of holding onto materials that he shouldn't have I believe it's something conservative media would have harped on. Honestly, this is the first time I've seen this allegation regarding Obama which is why the claim is setting off BS alarms for me.

One thing Trump excels at is making himself look bad.

If Obama was withholding documents since 2017, why didn't DOJ do something about it under the Attorney Generals Trump appointed? Seems like something they could have done and Trump would have wanted them to do.

Obama's papers were sent to Chicago because that's where his presidential library is going to be. Trump's is going to be in Florida, but he doesn't have the right to personally take papers to MAL. Since Reagan presidential papers are the property the US government and under the control of NARA.

Anything "taken to Chicago by President Obama" was done thru the National Archives. His team and the National Archive spent months going through the documents. NONE were taken to Chicago without having been cleared by the National Archives/U.S. Intelligence Services.

And guarantee you there weren't any sensitive "Top Secret" and Top Secret SCI/SAP" documents in any of the tranches.

Maybe it's just a minor point but . . . .

What I'd like to know is WHEN those classified boxes were removed from the White House. We just assume that Trump took them with him when the movers cleaned out all his personal belongings. But that may not be the case. He had a lot of time between November 3, 2020 and January 20, 2021 when he knew he'd lost the election. That would mean he had some very high level accomplices who knew they were breaking the law.

Not too many people can just walk into a classified storage location and say "give me dis, dat and everyting."

They'd make interesting witnesses if we knew who they were, plus how, by whom and when they were transported.

Or . . . at this point, does it even matter since the "there" is still there.

Right now, Trump is doing what he always does. Throw stuff out hoping something will stick that makes it look like what he did isn't so bad. He'll claim it's a witches hunt, that he's the most prosecuted ex-POTUS ever, that all his faithful should contribute to his legal defense, that he's innocent of all claimed infractions.

Yet he's fought returning any of these documents though his lawyers for months. His claim that all they had to do is ask for them is yet another in a long list of lies.

As the National Archives explained, they maintain Obama's classified materials "in a NARA facility in the Washington, DC, area" and noted that Obama "has no control over where and how NARA stores the Presidential records of his Administration."

Donald Trump continues to employ a spaghetti legal defense as he figuratively throws things against the wall to see if anything will stick (he already knows about catsup and other condiments/meal items will), after the FBI executed a search warrant at Mar-a-Lago earlier this week.

Trump has tried to claim that the documents in question were declassified. But there is no evidence of that, and legal experts say it is irrelevant under the criminal statues cited in the search warrant application and the FBI revealed classified information was obtained.

He has tried to claim the Department of Justice could have had the documents at any time, but the documents were reportedly subpoenaed and were apparently not turned over if the FBI found them at Mar-a-Lago on Monday ...

The bottom line is that there IS NO DEFENSE of the indefensible. Trump got caught red handed with his pants down and there's no place to run ~ except to his usual m.o., one appeal after another. Even his ace-in-the-hole, the U.S. Supreme Court, would have a hard time giving him a pass on this one.

One of the objects, of course, is to cut such a large swath of doubt among the undecideds that his candidacy for 2024 will be untenable. And hope that the disgrace brought upon the Republican Party will extend to the down tickets for Congress.

The word "Espionage" has such a nasty right to it. Even the dumbest of the dumb voters have watched enough movies to know what that means. If at all possible, I hope the DOJ puts it at the top of their list of charges.

This country is going to need a long succession of Democrats leading all three branches of government to completely eradicate the remnants of Russia's plot to overthrow the U.S. government.

I doubt it ~ at least not for the hard core or single issue voters. They're hopeless. It's the "undecided" who will be the most affected by words like "indicted" and "charged." And the charges will have to be more serious sounding than mis-management.

At least for the immediate purpose, I hope the DOJ will throw Espionage into the hopper. That's very serious business with all sorts of connotations.

The thought of investigating and indicting President Obama would have made Dotard's little mushroom turgid like it hasn't been since he was hanging with Epstein. I'm sure if there was even a whisper of impropriety he would have demanded that Sessions or Barr open an investigation or appoint a special council, and he would have Tweeted all about it years ago.
