Why not just call it what it is?

He noted that for some forcible felonies, such as second degree murder or kidnapping, suspects will be released without even having a detention hearing because of the way the new law defines flight risk.

"It's a very high burden and you have to show that they're actually in the process of contemplating it and you cannot use, well they have not showed up to court in the past on other cases, that's not even a factor," Devore said. "Proving high likelihood of flight is a red herring, it's almost never going to happen."

But let's make this about racism to justify placing the public in harms way.

Defendants are eligible for pre-trial release based on their risk, not their bank accounts. Learn more.

This "risk" assessment is really the issue.

This is what they said about the guy that beheaded a woman in San Carlos, low risk, to whom I suppose, people in Atherton, PaloAlto?

Just keep shakin' in your shoes. Don't forget to be afraid today. Oh the horror, people might get released. It's not like that doesn't happen now. Get a grip. Rank fear is unappealling.

Playing on it is demagogery.

Grow up.

Oh the horror poor* people might get released.

Fixed.

It's odd how they have no trouble with an actual dangerous person getting released on bail simply because they have the money, whereas they want some slob who stole a pack of hotdogs to sit for months because he doesn't.

It's also ironic how the "defenders of the constitution seem to hate it so much.

That pesky 8th amendment, the entirety of it, exists for a reason.

Just remember there was a time you had no right to an attorney. Justice for all is slow.

Yeah.

I'm really surprised they didn't take longer for 7-year-olds to get their heads splattered all over the wall because rights, of course.
