Charlie Savage: Former President Donald J. Trump's request that a judge intervene in the criminal investigation into his hoarding of government documents by appointing a special master increasingly looks like a significant blunder, legal experts say.

"Maybe from Trump's point of view, creating delay and chaos is always a plus, but this has the feel of a giant backfire," said Peter M. Shane, a legal scholar in residence at New York University and a specialist in separation-of-powers law.

For example, the judge has ordered Mr. Trump to submit by Friday a declaration or affidavit that lists any items on the inventory "that plaintiff asserts were not seized" in the search.

But if Mr. Trump acknowledges that the F.B.I. took any documents marked as classified from his personal office and a storage room at Mar-a-Lago, as the inventory says, that would become evidence that could be used against him if he were later charged with defying a subpoena.

Requiring Mr. Trump's lawyers to verify or object to the inventory also effectively means making them either affirm in court or disavow a claim Mr. Trump has made in public: his accusation that the F.B.I. planted fake evidence. While it is not a crime to lie to Fox News viewers or on social media, there are consequences to lying to a court.

Essentially, Judge Dearie is telling Mr. Trump's legal team "to put up or shut up," said Julie O'Sullivan, a Georgetown University professor of white-collar law.

Donald has been effing around almost his entire adult life. Now, it appears comes the finding out phase, and it's been far too long overdue.

The man is dumb as a box of rocks.

He just lets his emotions steer him regardless of anyone that gives critical thought to the issue.

He is used to people fixing his problems for him. Such a spoiled life. He assumed that by having a SM appointed by an R president would prove their fealty to him by doing his bidding and sacrificing their own reputation for him. It worked with that dumb judge in FL that granted the motion proving she is unfit for the bench.

He's really screwed the pooch this time.

'CNN, citing two sources familiar with the matter, reported Tuesday that Kise had been moved away from the Trump legal team's work regarding the Mar-a-Lago documents investigation. The report added that Kise, who left a law firm to take the job, was still expected to remain on the legal team, though it was not immediately clear why he was no longer leading work regarding the documents probe.

Attorney and commentator Tristan Snell offered several potential explanations as the reasons and sidelining itself remain unconfirmed by Trump.

"Trump spent $3 million upfront to get DeSantis lawyer Chris Kise onto his legal team for the Mar-a-Lago documents case. Now Kise is off the team. Why?" Snell tweeted. "Because he wouldn't lie to the Court? Because the money didn't come through? Because Trump fired him in a huff?""

Excellent article for getting some perspective on just how thoroughly Judge Dearie is putting teeth into his "can't have your cake and ear it too" observation. Whatever Trump was told about the judge almost certainly hasn't been borne out by events. What a nice, cool, long slurp from the exquisite, near-vintage Schadenfreude 2022 harvest this is. The selection of the Special Master could not have gone any worse for fmr Pres Trump unless, of course, his lawyers intentionally offered a Judge they knew would cut through all the lies fmr Pres Trump and his supporters have been proffering on social media, as Judge Dearie seems to be doing.

But, why would the lawyers risk their careers to do that?

Trump's error was letting one of his appointees who actually was an honest man be hi Special Mster. The Donald knrew better than that, hr, stupidly, thpught anyone he appointed to a judgeship would be loyal to him regardless of right or wrong.

And the worst $3 Million a political action committee ever paid.

Just so nobody gets the impression that $3 Million came from Trump's own pocket, it didn't. It was taxpayer money. Or from corporate donners.

That legal fee to retain Chris Rise was paid for by Save America political action committee which was set up by Trump in November 2020 in the aftermath of the presidential elections.

In which case, Trump, although the money was flushed down the drain, would consider it his due. He has a reputation for using and abusing political contributions from taxpayers and corporations alike.

It could have been intentional, but I'm not convinced. Trump makes all the legal decisions so he's probably the one who thought Judge Dearie was a safe pick. Trump makes bad decisions all the time, worse when he's under pressure, and his lawyers are stuck with doing the work-around ~ usually forced to the point of absurdity.

Chris Kise, even with a $3 Million up front retainer, made the right decision. He bailed. He said he didn't want to risk a criminal prosecution. Whether he meant a criminal prosecution of himself if he lied in court . . . or losing a criminal prosecution of his one and only client, Donald Trump, when the case went to trial. He didn't elaborate.

But the fact that Trump reassigned Kise to help with the civil case in New York told me that Trump intends to squeeze that $3 Million out of Kise, one way or another. That was quite a kick in the pants for a big shot criminal defense lawyer like Kise but still a safer option to save his own career ~ especially since he resigned as lucrative partnership in his former law firms to set up his own private practice with the $3 Million seed money.

...U.S. District Court Judge Aileen Cannon brushed aside an order from the special master in the Mar-a-Lago case requiring former President Trump to back his claims the FBI planted evidence in his home in an order that also extends the deadline for completing the review.

The order from Cannon comes after Trump's legal team penned a letter to Judge Raymond Dearie, the special master, complaining his "management plan exceeds the grant of authority from the district court on this issue."

In Thursday's order, Cannon agreed with Trump's team, saying his attorneys would not be required to affirm the accuracy of the FBI's inventory from Mar-a-Lago before getting a chance to review the records themselves....

If this continues at this pace, the DOJ will have no choice but to ask that Judge Cannon be removed from the case. Based on their national security argument and her bias, they're not going to tolerate her interference with their investigation much longer.

I don't know if she knows it or not, but Judge Cannon does not have the winning hand.

I told them, the papers are my personal mementos, but still they raided my house, they entered my house and didn't even wipe their feet very well. Terrible people, terribly corrupt people to not wipe their feet like that, but it's just a smear job. They went into my kid's room, into my wife's private closet and they had their shoes on, see. See how they disrespect me. And they put the papers on the floor, where they had their shoes, to make it look like I did that, like I was some kind of slob that throws the papers and folders just on the floor like that.

It would be a bit funny if Trump gets nailed for this stuff. Him hitting Hillary with "lock her up" about the server stuff and he finally gets caught because he mishandled documents himself, funny. Yes I get it she used the server while in China/Russia and it wasn't secured correctly, they probably saw everything but on a political level funny. He has been investigated more than probably any American at this point and they get him on something to be honest is minor for the most part. I understood the judge reversing SM, SM is suppose to review the documents FBI took not investigate if they took everything, he overstepped.
