Elie Mystal: Under John Roberts, the idea that the Supreme Court can police itself has been revealed to be an utter farce. Roberts tries to paint a rosy scenario, but the reality is that the court has become an ethical disaster under his watch. It will likely continue to be one, so long as he is in charge.

The Supreme Court operates with no statutory ethics rules and recognizes no authority higher than itself. It is up to each individual justice to decide for themselves whom they can meet with and whom they can talk to while they are deliberating their cases. If these justices want to talk with activists who have a vested interest in cases that are in front of the court, or simply share the outcomes of cases so the activists can jump-start their media campaign in defense of the justices' rulings, there is no law or rule to stop them.

Roberts could use his power to promulgate a code of conduct for his fellow justices, and strip them of the authority to write opinions if they don't comply. He could use his largely unfettered access to the media to advocate for statutory rules and punishments.

Instead, he does nothing other than promote the objective falsehood that the judiciary is good at policing itself.

A fish rots from its head down. So does an obviously compromised Supreme Court.

I remember when Roberts said: "I'll never allow MY Supreme Court to turn into a political football."

And then he did just that! And that's the way history will remember him if he doesn't turn things around.

Hmmm maybe that's why W. Bush appointed him, to be the Patsy for the Russian assets on the court like Alito and Thomas.

Roberts dearly wanted his name attached to the court, like "Warren Court." Well, Johnnie Boy, it is and will continue to be. And you're stuck with it. Tres effen triste.

It was obvious from the second the Dobbs decision was leaked - in addition to the WSJ being a recipient of said leak - that it was done by a justice on the right trying to insure that other conservative majority justices would not succumb to pressure from CJ Roberts like had happened during other cases where the preliminary vote changed before the final decision.

It only becomes more insidious that Alito then tried to imply that one of the liberal justices or their clerks were behind the leak and were responsible for threats to the justices due to the volatility of emotions surrounding the overturning of Roe v. Wade. He has become the poster child for "the ends justify the means" contingent of modern conservative jurisprudence embodied by The Federalist Society as his gross historically cherry-picked and patently false majority opinion made manifestly clear.

Has rhere been any doubt about the corruption of the Roberts Court since Bush v Gore? I was as obvious as rhe nose on the front of your face. Scalia's duck hunting trip with Cheney. There have been obvious conflicts of interest for decades. We have a corrupt SC, it bwcomwa more glaringly obvious with every passing year with Roberts sitting as Chief Justice. I expect Alito will be back up whining about the lack of reapect being expeessed. Soon comedians will be openly ridiculing the court for even pretending that the corruption isn't becoming undenably obvious.

The last court with a "dem majority" was 1970.

I will be dead and gone before another one ever occurs.

Tell me why you think it's alright to have a supreme court where several justices lied under oath to get the job, 1 seat was stolen by mitch mcconnell making up fake rules about when you can replace a judge, and a majority were appointed by presidents who got fewer votes than their opponents.

Also - whatever happened to that investigation into the abortion ruling leak? Did they find out it was a conservative and sweep it under the rug?

If the justices don't like the smell, they need to fix the problem. However the problem may be beyond their ability to fix. How justices are selected is the problem and just increasing the number is justices isn't the solution to the problem because, over time, we would end up with the same problem.

The change required is to not have the POTUS nominate and the Senate DIRECTLY approve justices. Justices should be chosen from appellate court judges on a random basis and serve for only a single term. After which they would rotate back to the appellate level.

How do any us know if they don't like the smell?

I suppose Roberts can take the kind of action suggested upthread and I wish he would take some action with regard to Clarence Thomas and his wife.

But it's doubtful that will happen.

But remember these justices simply take the call from the president when it's their opportunity. They don't get to select anyone else to be there.

And they are at the top level of their career. There are no more rungs to climb. What do you want them to fret over? Their career might be tainted? LOL. Think about that a little
