Garland assigned U.S. Attorney for the Northern District of Illinois John Lausch to find out how the classified material ended up at the Penn Biden Center. The review is considered a preliminary step, and the attorney general will determine whether further investigation is necessary, including potentially appointing a special counsel.

Lausch was nominated to be U.S. attorney by former President Donald Trump, and he is one of only two current Trump-era U.S. attorneys still serving. The other is Delaware U.S. Attorney David Weiss, who is leading an investigation into the president's son, Hunter Biden.

Let me explain to you the legal difference between No Criminal Intent (Joe Biden) and Criminal Intent (Donald Trump).

Joe Biden: Once the documents were discovered (not seized), President Biden's legal team followed proper protocol and returned the documents to the National Archives.

Donald Trump: Once the documents were seized (yes, seized) as a result of numerous requests (which were ignored) and at least two subpoenas, Trump embarked on an endless pursuit, vis-a-vis court cases, innumerable lies and other measures of deceit, to falsely claim ownership of the documents that rightly belonged to the National Archives ~~ all of which efforts failed and all of which opened up an investigation for Espionage and other lesser charges against Donald Trump.

So, here's your mountain out of a molehill.

Joe Biden ~ No criminal intent.
Donald Trump ~ Criminal intent, in spades.

You know what else happened in February 2017 (actually January 2o, 2017)? Donald Trump, who is a proud graduate of University of Pennsylvania's Wharton School of Business, became president:

It took a while (and subpoenas) before fmr Pres Trump reached the point of compliance where "The agents even said Trump completely complied ".

The National Archives had been asking fmr Pres Trump for the documents for months. When fmr Pres Trump refused to return them, the National Archives got the DoJ involved because of the possible classified documents.

I don't think this story will disappear until after the investigation when it turns into a nothing burger.

I think what will happen is that there will be a cursory investigation, determine that there was no criminal intent, and the media will stop treating it like the scoop of the century.

What we know so far:


While both presidents may have mishandled classified documents, the Trump investigation-- which is now being handled by Special Counsel Jack Smith--involves potential obstruction of justice. At this point, it appears Biden is complying fully with investigators.

As Sauber noted, the National Archives hadn't requested these documents from Biden. Instead, his team quickly alerted NARA of their existence. In contrast, NARA reportedly spent more than a year trying to retrieve materials from Trump after he left office. They found 184 classified documents, including 25 "top secret" documents, in 15 boxes of materials retrieved from Mar-a-Lago in January 2022. Months later, the Trump team turned over 38 more classified documents in response to a grand-jury subpoena--but the Feds came to believe that that they weren't complying fully. The Justice Department obtained a warrant to search Mar-a-Lago in August and recovered hundreds more classified documents.

All we know about the Biden classified documents so far is that they supposedly cover non-nuclear topics related to Ukraine, Iran, and the United Kingdom. Trump reportedly had a plethora of extremely sensitive documents in his possession, including information on a foreign government's nuclear capabilities and intelligence gathered by secret human sources.

Biden's lawyers found the documents, and what did they/Biden do? Tell no one and transfer the docs to a new box, then move them to a new location? Rip them up and throw them on the floor for others to discard? Flush them down the toilet? Toss them into the fireplace and burn them? Eat them? No, they/he turned them over to the NARA the next day. Realistically speaking, they didn't have to and no one would have been the wiser, but they did the right thing. It's not, however, what Trump would have done, did do. And, yes, all of the alternatives I listed are things Trump or someone on his team have been credibly accused of doing with his presidential papers. Apples to apples? I think not.

Trump lied about them, then declared he had magically unclassified them, and the very documents he said the FBI had planted all of a sudden became his personal property that he had actually taken from because "they're his."

If Trump had done what Joe Biden did with the recovered classified documents and contacted the National Archives right away, he'd be in the clear. Republicans should know that pointing to Biden doesn't create an equivalency, it just highlights what Trump did wrong.
