A federal judge sentenced a man to 80 months in prison for using pepper spray during the Jan. 6 Capitol riot against officer Brian Sicknick, who died hours later of natural causes.

Khater's attorneys argued his anxiety disorder, harsh conditions at the jail and remorse following the riot merited the lower sentence. "It's not in my nature. It's not who I am," Khater told the judge just before he was sentenced.

These long sentences lately are what's driving those still awaiting trial to ask for a "Hail Mary" subpoena for Trump as a witness for the defense.
