Drudge Retort: The Other Side of the News
Thursday, March 30, 2023

Jacob Chansley, the Capitol rioter known as the "QAnon Shaman" and arguably the most recognizable Jan. 6 defendant, has been transferred from a federal prison complex to a halfway house in Arizona, several months before he was initially set to be released.

... When the cops escort you around and the DOJ hid the videos ... ...

And that affected his sentence... how?

More from the article you cite...

...Federal prison records indicate Chansley is currently at a "residential reentry management" facility in Phoenix, with a release date of May 25. He was originally projected to be released in July 2023, but federal prisoners can earn reductions in sentences over the course of their time behind bars. ...

A Bureau of Prisons spokesman wouldn't comment specifically on Chansley's case, but noted in a statement to CBS News that the 2018 law known as the First Step Act changed how frequently federal inmates can earn sentence reductions, with credits last calculated in March....

So, he got to a halfway-house early for good behavior in prison?

@#10

Does the article your comment cites take into account the changes made recently to the guidelines?

www.azfamily.com

..."Recent changes have been made regarding First Step Act assessments such that the 28-day assessment will count as the first, and that an inmate will be able to earn 15 days after two assessments rather than three," a Federal Bureau of Prisons spokesperson told the outlet. "These additional time credits were calculated during the last scheduled application rollout in March 2023. therefore, these changes will allow inmates to earn the extra 5 days of time credit for every 30-day period."...

www.foxnews.com

..."For the record: Jake is out on schedule," Chansley's attorney Bill Shipley tweeted early Thursday morning.

"I told him 16 months ago in our first conversation it would be Feb. or Mar. 2023," Shipley said. "BOP [Federal Bureau of Prisons] math. I didn't do anything extraordinary"this was always the schedule, I just understood it and could explain it to him. He was expecting 12 more mos."...

You would think that Mr Chansley's lawyer would have at least thanked FoxNews.

Instead, FoxNews is reporting that Mr Chansley's lawyer 16 months ago expected this early release.

All that aside, a couple of other questions...

1) is being released to a half-way house still count as prison time? I'd think that if the prisoner is capable of such a change of venue that the Prison would want it, for the same reason why there are maximum-security prisons and low-security prisons.

2) if he were released to the halfway-house early due to what your comment asserts, your comment provides only a coincidence, not a correlation. Still no link backing up your implication "When the cops escort you around and the DOJ hid the videos..." ...

Escorted around? Hid the video?

In order to reach the Senate chamber he first attacked cops outside the building then broke in to the building and then attacked other cops.

As for having hidden a video there are hours of film showing the Twin Towers not being attacked on 9/11 are those hidden?

"He's leaving 14 months early"

Federal Bureau of Prisons spokesman Scott Taylor said Chansley was moved Tuesday from his low-level security prison in southeastern Arizona to a halfway house in Phoenix, where he will be released May 25.

Chansley"who also went by "Jake Angeli" and was known as the "QAnon Shaman""was set for a July release following his 2021 guilty plea for obstructing an official proceeding, after he joined the mob invading the Capitol and became one of a handful of rioters who stood at the presiding seat of the Senate Dais.

"Do we have any evidence that his early release was a direct result of the J6 tape release?"

According to the article, this act is behind his early release:

"A Bureau of Prisons spokesman wouldn't comment specifically on Chansley's case, but noted in a statement to CBS News that the 2018 law known as the First Step Act changed how frequently federal inmates can earn sentence reductions, with credits last calculated in March."

To me it looks like he got credit for good behavior and taking classes in accordance with the act:

On December 21, 2018, President Trump signed into law the First Step Act (FSA) of 2018 (P.L. 115- 391). The act was the culmination of a bi-partisan effort to improve criminal justice outcomes, as well as to reduce the size of the federal prison population while also creating mechanisms to maintain public safety.

#28 | Posted by Gal_Tuesday at 2023-03-30 05:05 PM | Reply

It also looks like the act is behind him being transferred to a halfway house (from above link):

Additionally, inmates who successfully complete recidivism reduction programming and productive activities can earn time credits that will qualify them for placement in prerelease custody (i.e., home confinement or a Residential Reentry Center).

To be determined.

However, during his court appearance he did seem to acknowledge his, let's call them, illegal digressions.

So... based upon his behavior in the halfway-house, will he be released back into society?

To be honest, I hope for all those who have had issues with the law to learn from their experiences and emerge a better person.

Hopefully, that will be the case here.

A friend I grew up with got 3 years in the fed system when he was included in a federal indictment over a drug case a year after graduation. He served his time in a minimum security fed prison in Terre Haute, Indiana. A couple of us went to visit him. Not hard time, that's for sure, and lots of freedom on the grounds. With the "big house" (medium (max?) looming across a large expanse of lawn, everyone there were motivated to stay between the lines or serve out their sentences doing hard time.

Seditious conspiracy is a more serious charge than insurrection. The jail terms are twice that of insurrection; 20 years versus 10 years.
www.csis.org

The "obstruction of an official proceeding" carries a maximum term of 20 years. This is what the "shaman" plead guilty to. That was due to his participation in the insurrection.

So we had an insurrection, that isn't even a question any more, and we had individuals that committed sedition, and we had a whole lot of people that participated in various acts to different degrees in the insurrection with various charges based on evidence and intent that could be proven in a court of law, or that they plead out to a lesser charge.

It is mind-boggling to say that because one individual wasn't charged and convicted of insurrection that no insurrection occurred. That is one of the strangest and ill conceived conclusions one could assert.
