"The appellate judges found on Monday that this tactic, which bypassed confirmation by the US Senate, violated the Federal Vacancies Reform Act.

Habba is the second Trump-appointed prosecutor to be disqualified in recent weeks.

Habba, 41, first joined Trump's personal legal team in 2021 after reportedly meeting him at his golf club in Bedminster, New Jersey.

She went on to represent Trump in his hush-money trial in New York last year, when he was convicted on 34 counts of falsifying business records. Trump has filed an appeal against that conviction."

If Lindsey Halligan was not lawfully appointed as interim U.S. Attorney in Virginia, any case she prosecuted is invalid and must be dismissed.

The indictments against individuals she prosecuted would be dismissed "without prejudice," meaning the cases could be refiled by a properly appointed prosecutor.

However, the specific case of James Comey faces an another complication because the statute of limitations may have expired.

Naturally the Justice Department has stated it will appeal the ruling.
