Federal agents arrested Judge James Benjamin Gosnell, Jr (68) of Charleston, on a criminal complaint charging him with possession of child sexual abuse material. DHS received a tip from the National Center for Missing and Exploited Children about multiple financial transactions with a known distributor of child pornography from the UK which led to the defendant. During the execution of a search warrant, HSI agents found a flash drive containing numerous videos and images depicting minors, infants, and toddlers engaged in sexually explicit conduct. Judge Gosnell was shackled during arraignment and denied bond. A criminal complaint is merely an accusation. All defendants are presumed innocent until proven guilty in a court of law.
South Carolina Judge Gosnell presided over the bond hearing for domestic terrorist Dylann Roof, who would later be convicted of the 18 Jun 2015 mass killing of nine black parishioners in Charleston. In November 2003, Judge Gosnell told a black defendant: "There are four kinds of people in this world " black people, white people, red necks, and n-""." The magistrate later explained to the office of disciplinary counsel at the state Supreme Court that he made the "ill-considered" statement to try to get the young man to change his life.
