US Park Police arrested Jan "Jay" Carey in August 2025 after he set "Old Glory" ablaze in Lafayette Square on the same day Dummkopf Trumpf signed an executive order against burning the flag. He pleaded not guilty to two misdemeanors -- igniting a fire in an undesignated area and lighting a fire causing damage to property or park resources -- brought by the office of Jeanine Pirro, the incompetent US Attorney for the District of Columbia.

Carey was not charged with flag burning as an executive order is not a law.

Flag burning is absolutely despicable. However it is protected under 1A. Just as "hate speech" is protected. 1A is designed to protect unpopular speech. Glad to see this case get tossed.
