Judge Allows 14 States' Suit Against Musk and DOGE to Proceed

She wrote in a 42-page order: "The Constitution does not permit the Executive to commandeer the entire appointments power by unilaterally creating a federal agency pursuant to Executive Order and insulating its principal officer from the Constitution as an 'advisor' in name only," the judge wrote. "This is precisely what Plaintiffs claim the Executive has done." Chutkan did, however, dismiss President Trump as a defendant, writing that "the court may not enjoin the President in the performance of his official duties."

I think it is quite telling that this ruling comes down THE EXACT SAME DAY that Elmo flees DOGE like a rat on a sinking ship.

I am surprised that she determined the creation of an illegal cabinet that is not constitutional is part of the presidents duties. I guess that was to prevent another challenge by tantrum toddler in chief up to the corrupt scotus to would rule in his favor. It's a crap shoot if the corrupt court side with him or try in a small way to take back their power. My guess is they would side with him under threat of impeachment of lumpy and alito by the GOP who cannot bend over enough to please hair furor.
