Jury nullification is certainly a tactic that individuals can deploy but even better would be laws that force the government (fed, state, muni) to pay for the legal defenses of the defendant if the defendant prevails plus extra for the defendant's lost income and pain and suffering. Hell, add in some more for punitive damages! That type of penalty would ensure that prosecutors only bring cases that they KNOW they will win. It would also ensure that defendants with a strong case would have no problem securing top notch legal representation.

A strong case can be made for reversing some precedents but no case can be made for decisions that are contrary to the explicit wording of the constitution!
