The statutory definition of rape in New York requires penile penetration. That is what why Trump filed his bogus defamation suit against Carroll the court dismissed the case. Forcing fingers into a woman's crotch is within the common understanding of rape and wasn't defamatory to someone found to have committed sexual assault.
