However, a felony charge does not make an accused individual a felon. They would not be considered a felon unless that have been tried and convicted as well.

For example, you can't give away $10,000 right before you apply for Medicaid; there's a five-year look-back. Same thing for gifts before a judgment. If he gave the gifts, say, 10 years ago, then they're probably unreachable. But 10 months ago, absolutely.
