If the Republicans in the Senate refuse to allow the nominee for a vote, have the vote ANYWAY and swear that justices in. The case then is: the Senate REFUSED their role of "advice and consent."

Think that is illegal? SCOTUS has already said anything the president is done in an official capacity is legal! Let that sink ion! Don't blame Trump alone!
