Appeals Court Upholds E. Jean Carroll's $83.3 Million Judgment Against Trump
An appeals court unanimously upheld a jury's $83.3 million judgment in writer E. Jean Carroll's defamation suit against Trump, who was found liable for sexually assaulting her in a department store dressing room in the 1990s.
The U.S. Court of Appeals for the Second Circuit noted that, while the damages award "approaches the upper limit of reasonableness," the sum was ultimately acceptable "in light of the extraordinary and egregious facts of this case." A 70-page ruling pointed to how Trump needed to be not just punished but deterred from making defamatory statements about Carroll in the future.
The court also rejected Trump's argument that he was entitled to presidential immunity in the case.
Carroll, an advice columnist, maintains Trump sought her advice upon running into her at Bergdorf Goodman, where he had gone to find a present for a female friend. Carroll said that Trump suggested lingerie, and then attacked her in an empty dressing room. Trump repeatedly called Carroll a liar, even after a jury found him liable for the attack, prompting her to sue him for defamation.
Trump is so unbelievably stupid he ran on releasing files he now says are a hoax.
