But the crux of the matter is this:
The 5th amendment says "no PERSON shall be arrested without due process." Not "no citizen," not "no person in the country legally.."
No PERSON will be arrested without due process
The accused get to face their accuser in this country.
Law enforcement should NEVER have the power to investigate, try, convict, sentence, and then implement the sentence. That destroys due process.
We have separate but equal branches for a reason
A judge should have signed a warrant. A judge should have held a hearing to ensure law enforcement arrested the right person. A judge Should have had a hearing to hear the facts from the accused and law enforcement.
That's how justice works in America for everyone. At least it's supposed to. There wasn't a judge anywhere in the process. It was unconstitutional as all get out.
