Then what you are arguing is that the US should have an open-border policy. That's fine, that's a policy discussion. I'm sure that the millions of US citizens coming into the US every day and having to suffer through long lines and passport control would enjoy not having to do that. But, whatever the policy is, it needs to be enforced. With regards to your argument, I'm not even sure where it would lead. Mom is still an illegal immigrant. She has not taken the steps required even to be a legal resident. Should ICE, and the rest of the USG, just ignore the law?

I think if you did a legal deep-dive, you'd find that the kids were not deported, they were sent to live with their primary caregiver.

Those kids will always be able to get a US passport from the closest US Embassy, and travel to and from the US whenever they want.
