No he's not.
There's a pending lawsuit on how the FAA denied 1000 or so controller applicants, jobs because of their skin color.
The FAA can't complain there's a controller shortage,
simpleflying.com
Then have 1000s of applicants denied.
FLASHBACK: FAA turned away qualified air traffic controllers based solely on race

So looking at the some of the ATC comms, a picture is forming....
There were two active runways 1 and 33, a little off of each other by about 40 degrees.
A plane was landing on 1.
ATC asked PAT25 if they had visual separation the AA flight landing (CRJ) on 33
Mistakenly PAT25 took ATC to mean the plane landing on 1 and confirmed separation.

There seems to be a contradiction there.

Did you read the specifics? No, then you're the one confused.
So, your current alias admits it may have not it on, because it is optional.
No it wasn't on because it wasn't recorded. Its not optional but they might have turned it off because they were flying a VIP, but then would have required a conversation with ATC before flight.
... DC is also under Special Flight Rules. ...
And that affects this current situation, how?
Be specific.
I am sure you won't read it but here are the specifics.

Again Military might have different rules, but I don't see why they should, seems like a enemy could take advantage if there were.
Probably incompetent Asian pilots.

Why should it have been on?

Well, the Military can turn it off with a switch. But GA, and commercial can't.
Within 30miles of a Bravo Airspace its has to be ON.

There are work arounds, but you need to call ATC to inform.
DC is also under Special Flight Rules.
