Supreme Court Bestirs Itself

"To the extent the Government removes even one individual without affording him notice and a meaningful opportunity to file and pursue habeas relief, it does so in direct contravention of an edict by the United States Supreme Court."

Yup ... "it is now or never for the Supreme Court to decide if we are a nation of laws, or a nation run by a lawless bully."

My money is on "run by a lawless bully".

If Roberts and Coney Barrett defect from the star chamber to affirm Rule of Law it will be surprising.

Stranger things have happened.

Reason for cautious optimism.

Some nations in South and Central America Banana Republics copied the US Constitution pretty much word for word. And then nobody paid attention to it. Presidents and different Congresses ignored it. The courts of those nations did not enforce it. But it was all on paper as "the law". Just a big farce.

Obviously, instead of them becoming more like us, the US has become a lot more like them.

The ACLU, acting with lightning speed, then dashed to Judge James Boasberg in Washington, D.C., to halt the apparent deportations (denied), back to the Northern District of Texas (denied) and up to the Fifth Circuit. Sensing the government might again rush migrants out from under the nose of the courts, the ACLU went to the Supreme Court

contemptuous cat-and-mouse game the government has been playing with the courts

cat-and-mouse game- not to be confused with judge/court shopping

...and up to the Fifth Circuit...

What did they say? "Denied" again?

There's not a doubt in my mind that the Roberts Supreme Court will give Trump a green light every chance they get if it's at all possible to twist wording of the Constitution in Trump's favor.

This just isn't one of those times.

while Trump wants to blast his way into a Dictatorship, Roberts is taking a more tempered approach.

My guess is that they both have each other on speed dial.

The only good supreme is Beef Supreme.
Maybe time to bring him and his flamethrower out of retirement.

What will scotus do when trump ignores them?

Unfortunately, I have absolutely no confidence in this SC upholding America against the president. Some have been bought and paid for years in advance of this situation. Some, like many in the congress, are afraid for the lives of themselves and their families. Americans on both sides are watching and waiting to see what happens if the president actually ignores the court. If he does, and congress does not step in, I think our republic may be doomed. It has happened before in other places, it can happen here.

NORTHGUY

"What will scotus do when trump ignores them?"

The SCOTUS doesn't have an enforcement branch. They can issue directives but depend on the Executive Branch or the DOJ to carry them out.

"What will scotus do when trump ignores them?"

Congresss will impeach him.

LOL. AAAAAAAAAAAAAAAAAAAAAAAAAAA!!! HAHA!

@#8 ... What will scotus do when trump ignores them? ...

Little or next to nothing.

Which may be a reason why the Roberts Court seems to be so reluctant to issue a definitive, no weasel-word, ruling against Pres Trump.

"Facilitate?"

I mean, really ...

-Well, he's a foreign citizen in his home country. What would you have happen? Black ops?

@#13 ... -Well, he's a foreign citizen in his home country. What would you have happen? ...

Interesting to see the apparent alternate alias start up when the other alias was shamed for it's responses.

That aside ...

... What would you have happen? ...

Simple. And in two words ...

Due Process.

so, extradition? to a foreign country, when not charged with a crime?

The extradition of fugitives under the provisions of this Treaty shall be carried out in the United States and in the Republic of El Salvador, respectively, in conformity with the laws regulating extradition for the time being in force in the State in which the request for the surrender is made.

tourist visa? not gonna happen.

the subject is on a terrorist watchlist, and has been adjudicated to be a member of a terrorist organization.
he is ineligible to enter the us.
there is no due process for him returning.

@#15 ... The extradition of fugitives under the provisions of this Treaty shall be carried out in the United States and in the Republic of El Salvador, respectively, in conformity with the laws regulating extraditiony ...

As your current alias cites ...

... in conformity with the laws ...

Can you say, Due Process?

#16 | Posted by LampLighter at 2025-04-21 01:23 AM

@#15 ... the subject is on a terrorist watchlist, and has been adjudicated to be a member of a terrorist organization.
he is ineligible to enter the us.
there is no due process for him returning. ...

I do note the apparent deflection of the lack of due process to remove him.

Trying now to assert now that there is no due process to return him.

Asked differently, if your current alias asserts there is no due process to return him, it does seem to implicitly admit that due process is a thing.

A thing that the Supreme Court asserted in its 9-0 decision.

What was the due process to send him to El Salvador?

So, what else er current alias got?

It is then upon Congress to impeach him. If they don't do their duty, they are ceding to dictatorship. As that's what I expect to happen, our representative republic is dead.
