Lindsay Clancy, the Massachusetts woman charged with killing her three young children, was back in court Tuesday morning for a hearing that could determine the future of the case. Three weeks ago, a judge declared a mistrial in the case after the jury failed to reach a unanimous verdict as a result of one juror who didn't agree she's not responsible for the killings. During the trial, Clancy didn't deny that she killed her children, and her attorney, Kevin Reddington, argued that she was suffering from postpartum psychosis and was overmedicated when she strangled the children and attempted to take her own life.

Typical Lawyer parsing.

She conceded that she killed them.

The trial was about whether she was "Legally" responsible, not whether she in Fact, Killed them.

This kind of ---- is why "insanity" defenses are so sleazy.

She's Guilty. Possibly Insane,..so What.

The holdout juror was correct.

She knew what she did was wrong or she wouldn't have tried to kill herself.

If she had bragged about killing them that would be insane too.

Would 11 jurors have wanted to Aquit?

Her argument was never that she didn't do it. From where I sit, she had two choices.

1. She claimed mental insanity and went to the insane asylum for life

2. A plea deal to get life in prison without parole.

She killed her children and wasn't having either of those - no, she wants to walk like it was nothing more than 3 late-term abortions because of a bout with depression.

Except it would not be for "life". Because that's not how it works. Once you are judged to be sane (postpartum depression is a temporary and treatable condition) she would be set free.

I doubt YOU would ever be judged to be sane.

The way Donner explains it, every woman who gave birth should be out of the delivery room into an insane asylum until they're judged to me sane. That would prevent this from ever happening again.

If I was to "explain" it I would say it would be more appropriate don't you think to make sure that every woman who gives birth gets adequate medical care when needed.

But. I'm not giving you any solutions. Only relaying what the facts are regarding her legal status if sent to an asylum. Because you obviously don't know.

It's a complex issue regarding free will and legal accountability and justice for the victims that I am not qualified to solve.

And neither was the court apparently and neither are you, obviously.
