In 2019, Sauer defended the state health department over its effort to revoke the license for Missouri's only abortion clinic, run by Planned Parenthood in St. Louis. As part of that case, it came out that the agency had been tracking the menstrual cycles of the Planned Parenthood's patients, supposedly in order to determine if any had failed abortion procedures.

After Missouri's administrative hearing commission found that the state had wrongly denied the clinic's license, and ordered the state health department to pay $146,000 to cover Planned Parenthood's legal bills, Sauer continued fighting. He argued the state shouldn't have to pay, and attempted to use the opportunity to pursue discovery and keep going after Planned Parenthood.

"This is not the little guy we're dealing with here," said Sauer. "This is the thousand-pound gorilla when it comes to litigation resources."

Sauer also spearheaded Missouri's defense of a law that attempted to block Medicaid funding for Planned Parenthood on the grounds that it is an abortion provider, when most of its work involves non-abortion services and many of its clinics don't provide abortions. The effort failed at the state Supreme Court.

In 2021, Sauer filed a brief for the Missouri attorney general in a case supporting an Arizona law that criminalized abortions based on genetic abnormalities. In another case involving Planned Parenthood, Sauer sought to have the Supreme Court approve a similar Missouri law that not only prohibited medical providers from performing abortions due to Down Syndrome, but from performing abortions at all after 8, 14, 18, or 22 weeks.

The Supreme Court declined Monday to take up an appeal from parents in Michigan and Virginia who accused Attorney General Merrick Garland of stifling their freedom of speech with a three-year-old memo that asked officials to look into threats directed at public school officials.

But lower courts waved off the litigation, noting that the memo did not include any new regulation and that it was geared at understanding threats of violence, not parents exercising their right to speak up at board meetings. The memo also does not label anyone a domestic terrorist.

The Biden administration urged the Supreme Court to toss the appeal, asserting that the parents "do not allege that the government has taken any action against them."

In recent months, there has been a disturbing spike in harassment, intimidation, and
threats of violence against school administrators, board members, teachers, and staff who
participate in the vital work of running our nation's public schools. While spirited debate about
policy matters is protected under our Constitution, that protection does not extend to threats of
violence or efforts to intimidate individuals based on their views.

Threats against public servants are not only illegal, they run counter to our nation's core
values. Those who dedicate their time and energy to ensuring that our children receive a proper
education in a safe environment deserve to be able to do their work without fear for their safety.
The Department takes these incidents seriously and is committed to using its authority
and resources to discourage these threats, identify them when they occur, and prosecute them
when appropriate. In the coming days, the Department will announce a series of measures
designed to address the rise in criminal conduct directed toward school personnel.
Coordination and partnership with local law enforcement is critical to implementing these
measures for the benefit of our nation's nearly 14,000 public school districts. To this end, I am
directing the Federal Bureau of Investigation, working with each United States Attorney, to
convene meetings with federal, state, local, Tribal, and territorial leaders in each federal judicial
district within 30 days of the issuance ofthis memorandum. These meetings will facilitate the
discussion of strategies for addressing threats against school administrators, board members,
teachers, and staff, and will open dedicated lines of communication for threat reporting,
assessment, and response.
The Department is steadfast in its commitment to protect all people in the United States
from violence, threats of violence, and other forms of intimidation arid harassment.
