Here is how i would treat the situation.
Make it insanely easy and fast for property owners to prove their ownership rights and evict squatters. In most jurisdictions i can pull a deed online in 5 seconds, and i can call the police in 5 seconds. The only thing missing is to link these two systems, which should not require a judge, multiple hearings, etc.
That said, if the "squatter" winds up having some bona fide right to be there (tenant, roommate, child, etc), and the owner abuses the quick squatter eviction process to evict someone who is not a squatter, they should be heavily penalized to deter abuse of the system. I'm talking lengthy prison time.
Additionally, i would not make it a crime to squat, except to the extent the squatter damaged the property or harmed someone in the process, both of which are already crimes under existing law.
What am i missing here? I know jack about squatting so someone tell me how this is bad.
This is a good learning opportunity to understand what freedom of speech means and what it doesn't mean. There are a lot of people out there who think they understand what it means......and they don't
