Immunity Decision Shows Conservative 'Originalism' is a Farce

Kimberly Wehle: In Trump v. United States, the Supreme Court's far-right majority showed Americans once again that "textualism" and "originalism" are a ruse. ... There's nothing whatsoever in the Constitution about immunity for presidents, unlike for members of Congress under the Speech and Debate Clause. In other words, the Framers knew how to afford immunity to federal officials when they wanted to. They didn't give it to presidents.

More

"From this day forward, Presidents of tomorrow will be free to exercise the Commander-in-Chief powers, the foreign-affairs powers, and all the vast law enforcement powers enshrined in Article II however they please -- including in ways that Congress has deemed criminal and that have potentially grave consequences for the rights and liberties of Americans."

Comments

"Time to change up the tactics.

The Supreme Court may be the only institution left that is less popular than the presidency. Biden should hit the road and take his case against the justices to the public."

Bush v Gore showed that any originalism was already a farce.
Then the Heller decision reinforced that notion.
Then Citizens United made it incontrovertible.
The Dobbs decision proved their decisions don't pass the smell test because of from where they are pulled.
And now the Trump decision ... There are no longer any adjectives that even fit.

Original idk has been a farce, a joke and a cover story for right wingers since the time of Reagan.

Republicans are always full of shht.

They used children to attack public education, libraries and civil rights.

They use women to attack transgender women.

They use xenophobia to attack immigrants.

They use religion to attack women's rights, civil rights, and personal freedoms.

The mindset of conservative people, globally, to subjugate everyone else to their beliefs and values, causes nothing but misery and strife, everywhere.

Don't forget "GRIDS" in the 80s, before they realized that AIDS wasn't a "gay disease"

#7 | Posted by hamburglar at 2024-07-03 07:59 PM

Ever see the AIDS rates among gay men vs everyone else?

Its not a surprise people thought of it as a gay disease.

"Its not a surprise people thought of it as a gay disease.

It is not strictly a 'gay disease' - it is a lifestyle disease that corresponds with gay lifestyle (multiple STD and treatments mean that they have poor immune systems), paired with popper use, they are destined to get it as well as with IV drug users for the exact same reason (poor immune system).

Outside of these people or people having sex with guys on the 'down low' there really is no transmission as even blood transfusions have been HIV free for decades. Also, I should note it is a GAY MENS disease as opposed to a LESBIAN disease as the lesbian lifestyle (less partners and drug use) have almost no HIV transmission.

This is just another bungled Anthony Fauci disease response - much like how they stopped talking about Monkey Pox being a gay man's disease after kids and dogs started to test positive...they definitely don't want the general public putting 2+2 together on that one.

This is the country we thought we lived in, but we were being played by Republicans for years [video at link]:

I am 100% for forcing Roberts to resign in 2025 for lying about his stance on this topic previously. Hopefully you will remain committed to your outrage and also call for his ouster.

Guess that the less than intelligent here do not recognize that this also protects former and future dem presidents as well -- but them again the narrow sighted with TDS reins here ; )

Not since the early 2000s.

Got a link to some current data?

Well, we could do it now - no way the Dems would be able to push through a confirmation before Jan 2025 so have at it. I think the Democrats will be VERY hesitant to actually do that because it is more likely you get another Alito rather than a compromise GOP like Roberts, Kavanaugh or ACB.

#15 | Posted by Claudio at 2024-07-03 11:21 PM

It is not strictly a 'gay disease' - it is a lifestyle disease that corresponds with gay lifestyle

Having to hide who you were in fear of social alienation or that some jackhole would assault you caused a lot of closeted homosexual men to take risks in order to meet other homosexual men for sex.

This is why I'd be interested in seeing recent data.

With homosexuality becoming more tolerated and accepted. Less homosexual men are taking the risks they once were and more healthy, long term relationships are becoming more common.

(I'm not saying men don't have risky sexual anymore.)

In 2021, ~80% of cases were either gay dudes, 71 - 73% (men who have sex with men or are transgender) or IV drug users, 7%.

Lesbians are more or less ZERO - it is not even a category that is tracked. Women do get HIV through 'hetero' contact but this is kinda lying as they are most likely to catch it from men on the downlow or that are 'prison gay'.

There clearly still is still a stigma effect to this which is why the groups most anti-gay (Blacks and Hispanics) continue to be over represented in new HIV infections while whites are decreasing.

It's a ruse. Time to expand the SC to 11 or 13. Things have gotten out of hand.

And remember how Merrick Garland didn't get a vote for months while Amy Coney Barret was confirmed weeks before the 2020 election? The double standards ... the grift and graft for which we only know the tip of. Project 2025 and judges ready to rubber stamp anything that helps the plot.

You sure you want to do that chief? Not a single Dem nominee will make it on the court prior to the 2024 election so the person appointing the expanded court in 2025 will be Trump packing on a few actual hardcore right wingers so we no longer have to tolerate the weak hands like Roberts or ACB. I am all for it. We agree to permanently cap the number at 13 and Trump gets another 4 right off the bat.

First of all, practically nobody gets AIDS anymore since the advent of antiretrovirals about 25 years ago.

HIV incidence:
70% MSM (Men who have Sex with Men)
22% Heterosexual contact
8% Drug users

Where's all this MSM sex happening?

Yeah, black gay dudes in the south - ever been to Atlanta? It is just as degenerate as San Francisco - just with less human poop on the sidewalks.

Black men will do that to a city, I guess.

They sure did take their time to actually admit there was a problem, once they realized AIDS affected not just -----. It's because Republicans are bigoted pieces of $#!+, who characterize being -----exual as "a lifestyle" and a "disease".

"They sure did take their time to actually admit there was a problem"

President Reagan first said the word "AIDS" in 1987 as I recall.

Back when Southern Baptists were telling us AIDS was punishment from G-d because America partially accepted gays as somewhat equal.
