This new case was filed by the American Civil Liberties Union, ACLU of New Hampshire, ACLU of Maine, ACLU of Massachusetts, Legal Defense Fund, Asian Law Caucus, and Democracy Defenders Fund on behalf of a proposed class of babies subject to the executive order, and their parents.

The ACLU is arguing that unborn babies have the right to birthright citizenship and are combining them into a class for a class action lawsuit. Unfortunately, arguing that unborn babies have rights pretty much ends the abortion debate - truly, what right is more fundamental than the right not to be murdered?

Please point to the court filing where the ACLU is making such a claim because neither the article you posted nor the filing linked in the article makes such a claim.
