"The American Civil Liberties Union and Democracy Forward sued the Trump administration over its use of the Alien Enemies Act. They said the administration removed people without due process.

Judge Patricia Millett said seemed to concur during oral arguments at the D.C. Circuit this week. "Nazis got better treatment under the Alien Enemies Act than what has happened here," she said. "They had hearing boards before they were removed."

"The White House has said the Venezuelans removed to El Salvador belonged to Tren de Aragua, a criminal organization designated by the Trump administration as a foreign terrorist group. But the administration has provided little evidence to back those claims.

In fact, the administration has conceded in court documents that many of the people on these flights to El Salvador didn't have criminal records in the U.S.

But it says that "the lack of specific information about each individual actually highlights the risk they pose."

Not America.

The cruelty is the point.

Not that we tried, but since we haven't proved the individual NOT in a gang, it's only safe to assume he is!

Our country is morally bankrupt.

No problem. Congress just needs to declare war.

With all the countries he wishes to deport people to.

Just curious as to how this would even remotely be constitutional, as we are not in a war.

Well if THAT is all it takes to push this hateful agenda through then I am sure Trumpy can start a war or two.

He can't. Only congress can start a war.

That's the point here, this ancient law doesn't have the concept of an undeclared war written into it, so any war it applies to must be declared. And the orange menace cannot do that.

The Supreme Court decision on this case will be quite telling.

Will the Supreme Court allow the trump administration to round up anyone and deport them with no due process?

imo, that's the gist here.

"He can't. Only congress can start a war."

Doesn't it only take a simple majority to declare war?

And Trumplicans in Congress and the Senate do whatever Dear Leader says.

And rollover Chucky certainly won't lead the charge to stop them.

I mean seriously if they are willing to try to give Trumpy a third term (which is a unconstitutional) they are willing to do anything for Trumpy.

They are already going to vote to authorize Trumpy to get Greenland any way he can. That's only one more vote away from declaring war on Greenland. H.R.1161 - Red, White, and Blueland Act of 2025

That's how insane Trumplicans are.
