Biden Pardons Vets Discharged for Same-Sex Relationships

President Joe Biden issued a blanket pardon today for the thousands of US military veterans who were convicted or forced out of the military under the Uniform Code of Military Justice article 125 which previously banned gay relationships.

See Burdick v United States, a pardon cannot be forced upon someone. They must accept it for it to be valid. Same thing happened when Biden issued a blanket pardon for those convicted under federal law for simple marijuana possession.

Sounds like it is even more complicated in this case as some of the reporting I've read indicates that the government may not even have clear records on who all is covered by this pardon. There are cases where military members avoided military prosecution in exchange for accepting an other than honorable discharge.

Yeah, the attack upon people who just wanted to serve their Country was unconscionable back then.

Being forced or coerced to accept a non-honorable discharge merely because you wanted to serve the Country was egregiously wrong.

Thank you for the clarification. I remember this was enforced during the Iraq invasion - a lot of Arabic interpreters were immediately discharged and replaced with Mossad.

The USMJ appears to be crafted with the intention of modular removal and replacement of persons with little delay.

Naturally it would require decades to be corrected./s

Done. After the mandate was repealed by Trumpers (first military vax mandate ever repealed) Only 43 rejoined the U.S. military following the repeal, according to CNN.
