Conservative Justices Sharply Question Trump Tariffs in High-Stakes Hearing

Chief Justice John Roberts, and Justices Amy Coney Barrett and Neil Gorsuch -- three conservatives -- sounded skeptical of the government's justification for the import duties.

Bloomberg reporter and former Donald Trump biographer Tim O'Brien thinks the one takeaway from the Supreme Court's argument over tariffs is that Chief Justice John Roberts may be trying to claw back the power the court handed to the executive branch.

"Sauer urged them to understand tariffs as a natural extension of other powers granted to the president under the law rather than a tax. "I can't say it enough - it is a regulatory tariff, not a tax," he said.

But that appeared to be a stumbling block for many of the justices.

"You want to say that tariffs are not taxes but that's exactly what they are," Justice Sonia Sotomayor said."

"President Donald Trump said Tuesday the Supreme Court case on his worldwide tariffs is "LIFE OR DEATH" for the U.S."

Some critics of Trump's tariffs, which he set on nearly every country in April, have said that Americans have received the brunt of the import taxes' impacts.

Attorneys for Learning Resources, an educational toy company that has taken exception to the tariffs, and Trump argued Wednesday about whether the president is allowed to use the International Emergency Economic Powers Act to set tariffs.

The 1977 law allows the president to regulate international trade to deal with "unusual" and "extraordinary" threats after declaring a national emergency."

Trump is our only REAL national emergency.

Here's the Prequal from yesterday:

"The Supreme Court Ruling That Could Upend Trump's Presidency

The court will hear arguments Wednesday in a challenge to the president's tariffs. Will the conservative justices once again twist themselves in knots to give him what he wants?"

excerpt
"That is a dubious assessment at best. Tariffs, contrary to the administration's messaging, are not levied on foreign producers or exporters.

They are instead paid by American businesses and individuals: either directly if they purchase something from overseas that is shipped to the United States, or indirectly if companies that import foreign goods raise their prices to accommodate the higher costs that tariffs inevitably produce.

The Treasury may be richer from the tariff regime, but Americans themselves are not."

Never mind the tariffs, SCOTUS. Dummkopf Trumpf wants to slowly irradiate the American population. Is anybody on the planet other than your humble Shakespearean Trotskyite felinophile on drudge.com, and the preeminent researchers at the Bulletin of American Scientists, aware of this? drudge.com

My questions at this point ...

How long will it be before SCOTUS releases its opinion and ruling? Will we wait until June so that SCOTUS can delay a ruling regarding Pres Trump again?

Will SCOTUS requite the tariffs to be refunded? The whimsical nature of Pres trump's tariffs might make that a rather difficult task.

This hearing did not go well for the DOJ and Trump.

They got eaten alive.

This hearing did not go well for the DOJ and Trump.

Nevertheless, the Court will rule in their favour.

His first round of tariffs included remote uninhabited islands. What was the emergency that required that?

"President Donald Trump said Tuesday the Supreme Court case on his worldwide tariffs is "LIFE OR DEATH" for the U.S."

I think a Justice asked the DoJ attorney, climate change could be considered "LIFE OR DEATH", or National Emergency.

Seems a bit dubious IMO, Trump and the DOJ will fail.

Nevertheless, the Court will rule in their favour.

I don't think so. It just doesn't make sense, its not a National Emergency.
