Montana SC: Trans Rights Same As Everybody Else's Rights

"Transgender discrimination is, by its very nature, sex discrimination," Justice Laurie McKinnon wrote in the court's decision. "Government issued identification documents are necessary to access public life. When they do not accurately reflect a person's sexual identity, the transgender Montanan is prevented, based on their sex, from obtaining the same attributes of public life that a cisgender Montanan may obtain. Hence, the inability of transgender Montanans to receive government-issued identification documents accurately reflecting their gender identity is fundamentally about the nature of sex and suspect class discrimination."

Comments

The quote alone juggles sex and gender...

"the transgender Montanan is prevented, based on their sex". Can't make it through a sentence without conflating the two.

This is always going to cause an impasse in this topic.

The impasse is pretty easily done away with if you'd just read what the judge wrote, though:

"Transgender discrimination is, by its very nature, sex discrimination"

I get it, the impasse arises with the rabid disagreement on this outside of this judge. Much like abortion the sides are far apart on key foundational issues, and we have had that wedge issue for decades.

Yayyyyyyyyyy good to hear that dear.

Why does being transgender bother anyone?

Because they're ignorant.

Transphobes have never met a transgender.

They base all their hate for transgenders on the opinions of hate spewing pundits who get paid to spread hate.

There's too much hate in America and it's what the Epstein class is using to control the nation.

"Why does being transgender bother anyone?"

Rumor has it some Dingaling was completely fooled by one in a bar somewhere once in front of his friends.

He will never let that go.

"Why does being transgender bother anyone?"

It doesn't, it's all made up outrage. Sure, there are always outliers, but figuratively, no one cares.

This whole movement is to keep you upset. Heck, it gives Snoofy a reason to live.

What people don't want is grown/adolescent males, dressed as women, in the same bathroom/locker room/sports field as their 12yo daughter.
If you don't have a problem with those scenarios, then why do you run around calling Trump a pedophile?
Because you appear to be OK with it if it happens.

"Transgender discrimination is, by its very nature, sex discrimination"

This is written by someone who doesn't understand science, and endorsed by someone who has proven his illiteracy regarding the gender/sex delineations and the foundation of their origin.

Can a transgender man impregnate a female with his sperm?
Can a transgender woman produce eggs with their own DNA?

Look I get you feel like a particular gender and want to participate in life that way;
Let us not confuse people that this is about sexual reproduction.

Gender discrimination is gender discrimination; Seperating the two, then trying to merge them back is the move of a charlatan.

You're creating a false equivalency when comparing transgenders to pedophiles.

Transgenders aren't pedophiles.

Trump is a pedophile.

You're a useful idiot for pedophiles.

"Why does being transgender bother anyone?"

The same reason being gay in public bothers them.

They're bigots, they're haters, they are no different than Charlie Kirk when he said:

"If I see a Black pilot, I'm gonna be like, Boy, I hope he's qualified"

The baked-in assumption here is that Charlie Kirk never wants to see a black pilot. If it were up to him, black pilots wouldn't exist.

And so it is with gays existing.

And so it is with trans people existing.

And I dare any Republican to refute the narrative.

Oh, I agree with that, but probably not the way you're hoping.

Which "foundation" do you think the anti abortion pro death penalty people are building their argument on?

"Why does being transgender bother anyone?"

I don't think it does.

If a trans-person gets arrested for a crime, and their license is based on identity rather than biology, how do they get processed into jail? Does a man who identifies as a woman go into a woman's jail? And if so, is that fair to the biological women in that jail?

Trannies go in with the Fellas.

I've seen that first hand.

Not bad to be locked down with.

More reasonable than Alphas, even when they Are Alphas.

Does a man who identifies as a homosexual go into a man's jail? And if so, is that fair to the straight men in that jail?

#11 | Posted by madbomber

Hey MadBomber,

You just said being transgender doesn't really bother anyone.

So it doesn't really bother you if it's fair or not, right?

I just want to make sure I'm understanding you correctly.

- "Why does being transgender bother anyone?"

Fear... of, 'the Other'. And a Judgement of them based upon that fear.

A sort of self-righteousness that doesn't even require a religious belief.
