Texas has sued General Motors for what it said is a years-long scheme to collect and sell drivers' data to third parties -- including insurance companies -- without their knowledge or consent.

... The lawsuit [PDF], filed yesterday in Texas state court, accuses both GM and its OnStar subsidiary of using telematics technology installed in most of its model year 2015 and later vehicles to transmit detailed driving data each time a vehicle is used.

Collected data was then sold to several data analytics companies to build driver scores, and the Lone Star state alleges GM required those firms to license access to insurance companies for the purpose of calculating rates based on their compiled data.

"Our investigation revealed that General Motors has engaged in egregious business practices that violated Texans' privacy and broke the law. We will hold them accountable," Texas Attorney General Ken Paxton said of the lawsuit. "Millions of American drivers wanted to buy a car, not a comprehensive surveillance system that unlawfully records information about every drive they take and sells their data to any company willing to pay for it."

The lawsuit alleges that more than 16 million GM customers had their data sold to third parties without their knowledge or consent, with 1.8 million of them residing in Texas, according to the petition. ...

Hmmm... do you own a recent GM vehicle and have seen an increase in your insurance rates?

They've been at this a lot longer than 2015 and onward. The last GM I bought was a Suburban when the kids were growing up and it came with OnStar. I got a free trial for a few months and opted out of the service. But they were still monitoring me because the dealership knew the mileage and sent notifications for certain services that were due.

And this was a 2003 model. If the check engine light were to ever to come on you were supposed to push the OnStar button and wait for someone to run a diagnostics on the vehicle via satellite, then give the OK to continue driving or have it towed as part of the warranty agreement- that was 21 years ago. They also knew your exact location because it sent them GPS coordinates should the airbags deploy.

And you didn't disconnect the cell modem WHY?

(I'm assuming this was several years ago. A 2003 is going to be using the 2G cell network, most of that has been shut down for years now.)

This is part of the reason I am looking for an older vehicle. We need some serious law around the collection and sale of our data. Europe is not perfect but at least they are getting SOME of this right - like People before corporations.

That said good on Texas' part but also shocking it is coming out of Texas. Does GM have some sort of gender policy that upsets Texans or something?

(I'm assuming this was several years ago. A 2003 is going to be using the 2G cell network, most of that has been shut down for years now.)

I wasn't worried about things like that back then. That, and I had no idea of how it worked. Didn't really pay attention to it until I began to see and understand the surveillance state.
