More: As Judge Jeffrey Brown, a Trump appointee, explains in the court's opinion, Texas lawmakers initially "didn't have much appetite to redistrict on purely partisan grounds" - even as Trump urged them to do so. But Texas Republicans appear to have changed their mind after the Justice Department sent a letter last July to Texas's top officials, which demanded that the state redraw several districts to change their racial makeup.

That letter, as I'll explain in more detail below, misread a federal appeals court opinion to mean that the state was required to remake its maps. According to Judge Brown's opinion, "it's challenging to unpack the DOJ Letter because it contains so many factual, legal, and typographical errors." He added that "even attorneys employed by the Texas Attorney General - who professes to be a political ally of the Trump Administration - describe the DOJ Letter as legally unsound,' baseless,' erroneous,' ham-fisted,' and a mess.'"

In reality, the Supreme Court has long held that "if a legislature gives race a predominant role in redistricting decisions, the resulting map" is subject to the most skeptical level of constitutional review and "may be held unconstitutional." When the Justice Department told Texas to redraw several of its congressional districts to change their racial makeup, it ordered Texas to give "race a predominant role." Oops.

What's next after a court blocked Texas' gerrymandered maps

... After a panel of three federal judges ruled 2-1 on Tuesday that Texas cannot use its new congressional map for next year's election, all eyes turned to the U.S. Supreme Court, which will decide whether to allow the ruling to stand.

The judges ordered Texas to instead use the map it drew in 2021, which favors Republicans but not as aggressively as the 2025 map.

What happens next will likely unroll in two key steps. First, the state is expected to ask the U.S. Supreme Court to temporarily pause the ruling, which would allow Texas to use the more recent map while the appeal plays out.

Then, they will ask the high court to rule on the merits of the case -- did Texas disenfranchise voters of color when redrawing its maps this year?

With the Dec. 8 filing deadline approaching quickly, an initial short-term pause could still have significant implications for which map Texas holds its 2026 elections under.

The request will go first to Justice Samuel Alito, a conservative member of the court who handles emergency petitions from Texas, but it would likely take a majority of the court to decide to pause the court's ruling.

Whatever happens, it will need to happen quickly. Texas' 30-day candidate filing period began on Nov. 8, meaning candidates have less than three weeks to decide what seats they are running for. To do so, they need to know whether the state will be using the map drawn over the summer, or the map drawn in 2021. ...

California took out the trigger language to reverse the gerrymandering based on the outcome of the Texas ruling. Because it was voted into effect without those provisions, our map is good to go.

Now we get to see a year's worth of Repubiclown whining about mail=in ballots and moaning about having fewer fascist cow farmers dragging us back to the 1860's...

I disagree with that assertion.

Strongly disagree.

I have respect for the farmers in the Country.

They feed us all. Period. Full Stop.

While I may have a political disagreement with them here and there, I will not ascribe the "fascist" appellation to them.

Occasionally,I like to sprinkle some grated parm cheese on the hot popcorn, instead of butter.

I do that for a change, as popcorn-munching seems to be more the norm of late.
